He said that w~s probably done inten- <br />tionally so as not to limit the authority of University city and the Council <br />in detexminlng what Would be a permitted use in a particular district, but if <br />the ordinance defined these terms, there would be a better understanding of <br />what would be permitted on these premises. He agreed with Mr. Hutchings that <br />this c~,~any had a product and was in a retail business. He noted that State <br />Statut~ say that sales taxes are assembled on physical products, but not on <br />everything that is sold or servlc~ ir~ M/ssouri. He said this business was <br />similar to that of a telephone store, and he felt it w-us totally cu~,~atible <br />with the other stores in this block. <br /> <br />Mr. Price asked how many people would ks expected to come to this business in <br />a day. Mr. Hutchings said the cu~,~ny ~licits the consumer through advertis- <br />ing; the consumer calls to get information; the c~uyf quotes a price for the <br />insurance; the customer then visits the office to obtain his policy. <br /> <br />Mr. Ollendorff said the main intent of the ordinance was to have retail busi- <br />r~ss in this area; an insurance policy is not a product or goods such as food, <br />clothing, furniture, etc. <br /> <br />Mayor Majerus said Council's intent in requiring site plan approval of Delmar <br />storefronts was to reestablish a lively and profi+~hle retail center. <br /> <br />All vct~ Aye to deny the site plan app3.ication. <br /> <br />The City Manager asked that Council add an item not listed with the regular <br />agenda. He said the Nigerian Cultural ~ociation applied earlier today for a <br />picnic license to sell beer and wine by the drink on Saturday, October 7, 1989 <br />at CASA A~torium, 560 Trinity for the performance of Babatunde Olatunji, one <br />of the ~ in Motion Arts Festival events. Mr. Adams so moved, with Mr. <br />Scb~xmner seconding the motion. All voted Aye. <br /> <br />Mrs. 'l"n~,i.c=~n mc~ved approval of the picnic license.
