Session 1825 <br />November 19, 2001 <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Schoomer moved adoption. Mr. Munkel seconded the motion. <br /> <br />Mr. Wagner wished to respond to Mr. Schoomer that it was arguable whether the <br />Council has discretion over approving this or not. <br /> <br />Mr. Munkel said that there are some two story homes not far away on Mapleview, so <br />there is some precedence to allow this. On his street of Gannon, there is a mixture of <br />single, one and one-half and two story houses. There is a mix in our City. What is <br />proposed fits within that design. This development will clash in the aspect that it is a <br />new design mixed with older designs. He agrees with Mr. Schoomer on this that we <br />don't have much choice without risking a law suit. We really have to approve it. <br /> <br />The question was called. <br /> <br />The roll call vote was as follows: AYES: Mr. Munkel, Mr. Schoomer, and Mayor Adams. <br />NAYS: Mr. Wagner, Mr. Lieberman, Mr. Sharpe, Ms. Colquitt. Bill number 8564 failed <br />by a vote of four to three. <br /> <br />BILL NO. 8565 - AUTHORIZING THE CITY MANAGER, ON BEHALF OF THE <br />CITY OF UNIVERSITY CITY, TO ENTER INTO AND EXECUTE AN <br />AGREEMENT WITH THE MISSOURI HIGHWAYS ANED TRANSPORTATION <br />COMMISSION WHICH PROVIDES THAT THE CITY SHALL RECEIVE GRANT <br />FUNDS FOR TRANSPORTATION ENHANCEMENT ACTIVITIES ON OLIVE <br />BOULEVARD PHASE ;! <br /> <br />The bill was given its second reading. <br />The bill was given its thiird reading. <br /> <br />Mr. Munkel moved adoption. Mr. Sharpe seconded the motion. The roll call vote was <br />as follows: AYES: Mr. Wagne~r, Mr. Lieberman, Mr. Schoomer, Mr. Sharpe, Ms. <br />Colquitt, Mr. Munkel, Mayor Adams. Bill number 8565 passed and became Ordinance <br />6339. <br /> <br />BILL NO. 8566 - AMENDING CHAPTER 8.28 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO THE PROPERTY MAINTENANCE CODE, <br />BY REPEALING SUBSIECTION PM-112.4.2 OF SECTION 8.28.020 THEREOF, <br />RELATING TO CONDITIONAL PERMITS, AND BY ENACTING IN THEREOF A <br />NEW SUBSECTION TO BE KNOWN AS "PM-112.4.2 CONDITIONAL PERMIT, <br />"THEREBY AMENDING SUBSECTION PM-112.4.2 SO AS TO SHORTEN <br />FROM NINEY (90) DAYS TO SIXTY (60) DAYS THE PERIOD IN WHICH <br />PREMISES SHOULD BE BROUGHT INTO COMPLIANCE WITH THE CODE <br /> <br />7 <br /> <br /> <br />
