The easement is for utilities. Mr. Shepard’s house and <br />sidewalk encroach on the City’s easement. He plans to sell his house and move <br />out of town, and wants for him and the future owner to be free and clear of the <br />encroachment on the City’s easement. <br /> <br />All six utilities have no objection to the City vacating the portion of easement. <br />The area for proposed vacation is 5’ x 58’, and is shown highlighted on the <br />attached Boundary Retracement and Improvement Location Survey. <br /> <br />Attached is a draft ordinance for the City to vacate the portion of the easement. <br />The only adjacent property owner affected is Mr. Hempel, at 829 N. Jackson. <br />The property owner was notified on May 24, 2007. The letter requested that he <br />notify the City if he objected to the City vacating the portion of the easement. <br />The property owner has not responded. <br /> <br /> <br /> <br /> <br />RECOMMENDATION: <br /> <br />The Public Works Department recommends that the City vacate the easement. <br /> <br />K-2-a <br />June 18, 2007 <br /> <br /> <br />
