INTRODUCED BY: ____________ DATE: _________________ BILL NO.:_________ ORDINANCE NO.: ______ AN ORDINANCE VACATING AND SURRENDERING A PART OF THE RIGHT- OF-WAY OF WEST KINGSBURY AVENUE, BUT RESERVING ANY PUBLIC UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI . WHEREAS, West Kingsbury Avenue is a public street in University City, in St. Louis County, Missouri; and WHEREAS, due notice of a public hearing on the vacation of part of said public street, to be held by the City Council of the City of University City in the City Council Chambers at City Hall on ____________, 2007, at 6:30 p.m., was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on ____________, 2007; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said vacation were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. A part of the right-of-way of West Kingsbury Avenue in University City, in St. Louis County, Missouri, and all of University City’s right, title and interest therein is hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; said property is more specifically described as follows: A track of land being part of West Kingsbury Avenue, 40 feet wide, being in Township 45, Range 6 East, University City, St. Louis County, Missouri. Section 2. Said right-of-way is further described as shown hachured on the attached Right-of –Way Vacation Exhibit, marked Exhibit “A” and incorporated herein by this reference thereto. Section 3. The City Clerk is hereby directed to have this ordinance recorded in the office of the Recorder of Deeds of St. Louis County, Missouri. July 16, 2007
