RESOLUTION 2015 - 18 <br /> RESOULTION ESTABLISHING A VOLUNTARY FLOOD BUYOUT <br /> POLICY FOR THE CITY OF UNIVERSITY CITY, MISSOURI <br /> FY 2014 FMA/SRL VOLUNTARY FLOOD BUYOUT PROJECT <br /> BE IT RESOLVED BY THE CITY COUNCIL OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> Section 1. The Federal Emergency Management Agency (FEMA) has approved grant funding through <br /> the Flood Mitigation Assistance (FMA) Program for the acquisition and demolition of three (3) flood-prone <br /> residential properties located on Wilson Avenue. Specifically, $486,017.60 in Federal funds is granted for the <br /> completion of the FY 2014 FMA/SRL Voluntary Flood Buyout Project (the "2014 FMA/SRL Project). The City <br /> has executed FEMA's Flood Mitigation Assistance Program Funding Approval and Grant Agreement forms. <br /> The City has agreed to accept responsibility for adherence to all grant requirements. <br /> Section 2. The City is required by FEMA to adopt a Voluntary Flood Buyout Policy. The City's FY <br /> 2014 FMA/SRL Voluntary Flood Buyout Policy (the "2014 FMA/SRL Policy) is hereby approved in substantially <br /> the form attached hereto as Exhibit A. <br /> Section 3. Representatives of the City are hereby authorized to use such policies in connection with <br /> the acquisition and demolition of the residential properties on Wilson Avenue. <br /> Section 4. The City does hereby provide the necessary assurance that restrictive covenants shall be <br /> conveyed in the deed to any property the City acquires through FEMA's Flood Mitigation Assistance Program, <br /> as follows: 1) The property shall be dedicated and maintained in perpetuity for uses compatible with open t` <br /> space, recreational, or wetlands management practices; 2) No new structure(s) will be built on the property, <br /> except as approved under Title 44 of the Code of Federal Regulations, Section 206.434(d) <br /> (44CFR206.434(d)); and, 3)After completion of the project, no application for additional disaster assistance will <br /> be made for any purpose with respect to the property to any federal entity or source, and no federal entity or <br /> source will provide such assistance. <br /> Section 5. Only properties meeting the following requirements are eligible to participate in the Wilson <br /> Buyout Project: 1) The property must be listed in the original buyout application submitted to FEMA or later <br /> officially amended to the buyout by both the Missouri State Emergency Management Agency (SEMA) and <br /> FEMA, and 2) The property must be a primary residential home. Vacation homes, clubhouses or businesses <br /> are not eligible for acquisition under this buyout program. <br /> Section 6. As required by SEMA, any changes and additions to the 2014 FMA/SRL Policy will be <br /> reviewed by an advisory committee consisting of representatives from SEMA and the City Council. In the <br /> event of disputes, differences of interpretation, or disagreements over the guidelines, the decision of the City, <br /> acting by and through the City Council, shall be final and in all cases shall be the determining factor, after <br /> consultation with SEMA. <br /> Section 7. The Mayor, the City Manager and other officers and representatives of the City are hereby <br /> authorized and directed to take such other action as may be necessary to carry out the 2014 FMA/SRL Project. <br /> Section 8.
