Regular Session <br />June 26, 2006 <br /> <br />Mayor Adams called for a voice vote of Councilmembers in favor of the appointment be for <br />the remainder of the term, April 2008. Mayor Adams concluded that the Ayes had it. <br /> <br />A roll call was requested with the following result: <br />AYES: Ms. Brungardt, Mr. Wagner, Ms. Brot, Mr. Glickert <br />NAYS: Mr. Price, Mr. Sharpe Jr. and Mayor Adams <br /> <br />The Ayes were of the majority to appoint the replacement Councilmember for Ward Two until <br />the Municipal election of April 2008. <br /> <br />The timeline was then discussed. It was concluded that all potential applicants need to <br />submit an application by July 19, 2006. At the Regular Council session on July 24, each <br />applicant would then be asked to give a short presentation on why they would like to be the <br />Councilmember for Ward Two. The Council would then have a public vote, selecting the <br />three finalists. Council would then prepare final questions to be asked of each candidate, <br />which would take place at a Special Public Session before the Regular Council Session now <br />scheduled for August 14, 2006. The Council next would have a public vote at this newly <br />called Regular Council session, August 14, 2006, to choose the Councilmember Ward Two <br />replacement. Mr. Sharpe asked Mr. Mulligan, the City attorney, if the final candidates can be <br />sequestered as Council interviews one at a time. Mr. Mulligan said that this would not violate <br />the Sunshine Law. <br /> <br />Discussion then pursued as to having the vote in a Public or Executive session. The <br />pertinent Sunshine law was then presented and explained as to why this would have to be a <br />public session. Previous rulings have stated that the Mayor and Council are elected officials, <br />not considered personnel of the City. Executive session can only be called for three areas: <br />legal, personnel and/or real estate. <br /> <br />The Council’s voting method was briefly discussed; the Council decided that there would be a <br />ballot voting form created. <br /> <br /> <br />The next regularly scheduled Council meeting will be July 10, 2006. <br /> <br />The Regular Council session concluded at 9:15 p.m. Mr. Wagner moved that Council go into <br />Executive session to discuss Legal issues and was seconded by Mr. Glickert. <br /> <br /> <br /> <br />Joyce Pumm <br />City Clerk <br /> <br /> <br /> <br />Page 7 <br />
