<br />Board of Adjustment <br />April 18, 2016 Meeting Minutes <br />(approved 5-16-16) <br />A Board of Adjustment meeting was held on Monday April 18, 2016 at the Heman Park <br />Community Center located at 975 Pennsylvania Ave., University City, Missouri. The meeting <br />commenced at 6:30 pm. <br />Members Present Members Absent (excused) <br />John Solodar, Chairperson Roger McFarland <br />Deborah Arbogast, Vice-Chairperson Peggy Holly <br />Kathy Straatmann <br />Charles Marentette, Alternate <br />Denise Anderson, Alternate <br />Non-Voting Members Present <br /> <br />Rod Jennings, Council Liaison <br />Staff Present <br />Raymond Lai, Deputy Director of Community Development <br />Zach Greatens, Planner <br />1. Approval of Minutes <br /> <br />The minutes from the November 16, 2015 Board of Adjustment meeting were approved. <br />2. Case # BOA 16-01 7026 Lindell Blvd. <br />Mr. Adam Zucker, property owner of 7026 Lindell Blvd., requested a variance to construct a <br />detached garage maintaining a side yard setback of two and one-half (2.5) feet in lieu of five <br />(5) feet from the western property boundary and a rear yard setback of three (3) feet in lieu <br />of five (5) feet from the southern property boundary as required by Sections 400.160.B and <br />400.1090.A of the Zoning Code. <br /> <br />Mr. Zucker explained the proposal and situation with the existing shared detached garage <br />(shared with adjacent property to west 7030 Lindell) with the property line going down the <br />middle of the garage. He stated that if a new detached garage were to be constructed in <br />conformance with the five foot side yard setback requirement, the existing tree in the middle <br />of the rear yard would be damaged. If a garage were to be constructed in conformance with <br />the five foot rear yard setback requirements, it would be too close to the existing steps and <br />retaining wall to have access. He stated they would like to construct a one-car garage. Mr. <br />Zucker stated there were other garages in the neighborhood that were less than five feet from <br />the property lines. <br />Board members discussed the proposal and the concerns about the tree in the yard. Based <br />on feedback from the City Forestry Supervisor, if a new structure were to be constructed in <br />the rear yard, it would have to be at least 4.5 feet from the tree for it to have a chance of <br />survival and the further from the tree, the better chance it would have.
