<br />INTRODUCED BY: Ms. Brot DATE: July 16, 2007 <br /> <br /> <br />BILL NO.: 8945 ORDINANCE NO.: <br /> <br /> <br />AN ORDINANCE VACATING AND SURRENDERING A PART OF THE RIGHT- <br />OF-WAY OF WEST KINGSBURY AVENUE, BUT RESERVING ANY PUBLIC <br />UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE <br />RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS <br />COUNTY, MISSOURI . <br /> <br /> WHEREAS, West Kingsbury Avenue is a public street in University City, <br />in St. Louis County, Missouri; and <br /> <br /> WHEREAS, due notice of a public hearing on the vacation of part of said <br />public street, to be held by the City Council of the City of University City in the <br />City Council Chambers at City Hall on May 21, 2007, at 6:30 p.m., was duly <br />published in the St. Louis Countian, a newspaper of general circulation within <br />said City, on May 4, 2007; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified <br />in said notice, and all suggestions or objections concerning said vacation were <br />duly heard and considered by the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. A part of the right-of-way of West Kingsbury Avenue in <br />University City, in St. Louis County, Missouri, and all of University City’s right, <br />title and interest therein is hereby vacated, surrendered and quitclaimed, <br />reserving, however, all public utility easements, if any; said property is more <br />specifically described as follows: <br /> <br /> A track of land being part of West Kingsbury Avenue, 40 feet wide, being <br />in Township 45, Range 6 East, University City, St. Louis County, Missouri. <br /> <br /> Section 2. Said right-of-way is further described as shown hachured on <br />the attached Right-of –Way Vacation Exhibit, marked Exhibit “A” and <br />incorporated herein by this reference thereto. <br /> <br /> Section 3. The City Clerk is hereby directed to have this ordinance <br />recorded in the office of the Recorder of Deeds of St. Louis County, Missouri. <br /> <br /> Section 4. This ordinance shall take effect and be in force from and <br />J-7-b <br />August 6, 2007 <br /> <br />
