Council Agenda Item Cover

___________________________________________________________

MEETING DATE:
October 1, 2007

AGENDA ITEM TITLE:
An Ordinance approving a settlement agreement with
Verizon Wireless and assigning a percentage of the
settlement proceeds to the St. Louis
County Municipal League.

AGENDA SECTION:
New Business

CAN THIS ITEM BE RESCHEDULED? :
Yes

BACKGROUND REVIEW:
The courts have given preliminary approval to a settlement
between Verizon and all municipalities on the cell phone tax issue. Verizon and the
municipal attorneys agreed that Verizon would pay two years back taxes and attorneys
fees. Each city may provide a percentage of their back taxes to the MML or the St. Louis
County Municipal League. The ordinance attached would attribute an unspecified
percentage to the St. Louis County Municipal League (Section 3). The League has
requested a 5% payment of the back taxes which would equate to $20,833 and reduce our
settlement amount to $395, 834. Council will need to discuss and amend the ordinance to
insert the percentage you feel appropriate. The eighty-two page settlement agreement is

available in the City Clerkâs Office.

RECOMMENDATION:
Staff recommends approval.

K-2-a
October 1, 2007
