Session 1865
January 13, 2003

All voted for the amendment except Councilperson Lieberman.

Mr. Lieberman noted that historically there had been no reason to enforce "no parking"
Ordinances when the location was occupied by an empty building. He held that the ban
should remain in place, be enforced and that "grandfathering" an illegal act is not good
legislation. He moved for defeat of Bill 8636.

Ms. Welsch, who serves on the Traffic Commission, said that she wished that a
compromise had been reached sooner but proposed that the Bills be passed, that staff
monitor the situation and report back to Council so it can take immediate action if
needed.

Mr. Sharpe said that he hoped that Mr. Lieberman and Mr. Wagner would be able to
obtain some sort of reconciliation between both interests.

BILL 8636 - AN ORDINANCE AMENDING CHAPTER 10.44 OF THE
CITY CODE, RELATING TO PARKING RESTRICTIONS ON SPECIFIC
STREETS, BY REPEALING SECTION 10.44.010 THEREOF, RELATING
TO PARKING PROHIBITED ON CERTAIN STREETS AT ALL TIMES,
AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN
AS "SECTION 10.44.010 PARKING PROHIBITED ON CERTAIN
STREETS AT ALL TIMES," THEREBY AMENDING SAID SECTION SO
AS TO PROHIBIT PARKING AT ALL TIMES BY COMMERCIAL
VEHICLES IN THE ALLEY BETWEEN KINGSBURY BOULEVARD AND
PERSHING AVENUE, AND NONCOMMERCIAL VEHICLES IN CERTAIN
PARTS OF THE ALLEY; CONTAINING A SAVINGS CLAUSE AND
PROVIDING A PENALTY.

The bill was given its second reading.
The bill was given its third reading.

The vote was then taken and the motion carried with one nay from Mr. Lieberman.
Bill number 8636 passed and became Ordinance number 6406.

Mr. Wagner moved approval. Mr. Sharpe seconded the motion. The roll call
vote was as follows: AYES - Ms. Colquitt, Mr. Munkel, Mr. Wagner, Ms. Welsch,
Mr. Sharpe, Mayor Adams. NAYS - Mr. Lieberman. Bill number 8636 passed
six to one and became ordinance number 6406.

BILL 8637 - AN ORDINANCE AMENDING CHAPTER 10.40 OF THE CITY
CODE, RELATING TO STOPPING, STANDING AND PARKING GENERALLY,
BY REPEALING SECTION 10.40.100 THEREOF, RELATING TO STOPPING,
STANDING OR PARKING PROHIBITED IN STREET OR ALLEY UNDER
CERTAIN CONDITIONS, AND ENACTING IN LIEU THEREOF A NEW

4
