Session 1865 <br />January 13, 2003 <br /> <br />All voted for the amendment except Councilperson Lieberman. <br /> <br />Mr. Lieberman noted that historically there had been no reason to enforce "no parking" <br />Ordinances when the location was occupied by an empty building. He held that the ban <br />should remain in place, be enforced and that "grandfathering" an illegal act is not good <br />legislation. He moved for defeat of Bill 8636. <br /> <br />Ms. Welsch, who serves on the Traffic Commission, said that she wished that a <br />compromise had been reached sooner but proposed that the Bills be passed, that staff <br />monitor the situation and report back to Council so it can take immediate action if <br />needed. <br /> <br />Mr. Sharpe said that he hoped that Mr. Lieberman and Mr. Wagner would be able to <br />obtain some sort of reconciliation between both interests. <br /> <br />BILL 8636 - AN ORDINANCE AMENDING CHAPTER 10.44 OF THE <br />CITY CODE, RELATING TO PARKING RESTRICTIONS ON SPECIFIC <br />STREETS, BY REPEALING SECTION 10.44.010 THEREOF, RELATING <br />TO PARKING PROHIBITED ON CERTAIN STREETS AT ALL TIMES, <br />AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN <br />AS "SECTION 10.44.010 PARKING PROHIBITED ON CERTAIN <br />STREETS AT ALL TIMES," THEREBY AMENDING SAID SECTION SO <br />AS TO PROHIBIT PARKING AT ALL TIMES BY COMMERCIAL <br />VEHICLES IN THE ALLEY BETWEEN KINGSBURY BOULEVARD AND <br />PERSHING AVENUE, AND NONCOMMERCIAL VEHICLES IN CERTAIN <br />PARTS OF THE ALLEY; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />The vote was then taken and the motion carried with one nay from Mr. Lieberman. <br />Bill number 8636 passed and became Ordinance number 6406. <br /> <br />Mr. Wagner moved approval. Mr. Sharpe seconded the motion. The roll call <br />vote was as follows: AYES - Ms. Colquitt, Mr. Munkel, Mr. Wagner, Ms. Welsch, <br />Mr. Sharpe, Mayor Adams. NAYS - Mr. Lieberman.
