B. Within seven (7) days of receipt of an application by the <br />director, the department of public works shall determine whether the <br />proposed location of the news box complies with Section 5.100.XXX. If <br />the proposed location complies with Section 5.100.XXX, the director shall <br />issue a license. If the proposed location does not comply, the director shall <br />deny the application and state the reasons for denial in writing. The <br />director shall issue or deny the license within seven (7) days of receipt of <br />the receipt of the department of public works’ compliance determination. <br />C. Each news box license shall have a separate license number <br />for the administration of this chapter. The director may impose provisions <br />and conditions consistent with this chapter on each news box license. <br />D. After receipt of a license, a distributor may install a news <br />box at the approved location in compliance with the license so issued and <br />this chapter. <br />Section 5.100.040 Location and Placement <br />No news box shall be placed, installed, located, used, or maintained: <br />A. Within one and one half (1 1/2) feet of the face of any curb; <br />B. Within five (5) feet of any fire hydrant; <br />C. Within five (5) feet of any marked crosswalk; <br />D. Within twelve (12) feet of the intersection of the property <br />lines at any street corner; <br />E. At any location where the width of the paved clear space in <br />any direction for the passage of pedestrians is reduced to less than five (5) <br />feet; <br />F. On any tree lawn, except where a building permit is issued <br />for construction of a concrete walk in the tree lawn area for the placement <br />of a news box, so that the news box is placed and is accessed by the public <br />on the concrete walk, provided written approval is obtained from the <br />owner of the property immediately adjacent to the tree lawn; <br />G. That is chained or otherwise secured to any tree, utility <br />pole, light standard, traffic control device, street sign post or other public <br />property or private property; <br />H. Within the right-of-way surrounding any city park; or <br /> <br />
