Session 1869 <br />February 24, 2003 <br /> <br />The bill was given its third reading. <br /> <br />Mayor Adams called on citizens to speak regarding this issue. <br /> <br />Pat Fitzgerald, 6374 Pershing, requested that the City Council withhold <br />approval of this bill in order to study the negative impacts that constructing <br />MetroLink will cause in University City. She feels that the City Council <br />should study the benefits of Bus Rapid Transit in place of MetroLink. It is <br />less destructive on the City as well as better for the budget. Metrolink <br />construction will cause traffic to be adversely affected for two years and <br />she wondered how we would manage. She believes that this easement <br />ordinance is one of the last chances the City will have to make our wishes <br />known and make them stick. The City should also consider placing a <br />clause in the ordinance to make Bi-State reimburse the City for the extra <br />police and traffic work that will need to be monitored during the Metrolink <br />construction process. <br /> <br />Mr. Wagner had three concerns that he wished to discuss prior to voting <br />on this bill. <br /> <br />Mr. Wagner inquired of the City Manager regarding a restoration clause <br />within the ordinance. He does not see one included and feels strongly <br />that one must be. <br /> <br />Mr. Ollendorff stated that under Section IV, this is addressed. Mr. Wagner <br />replied that he did not feel that it was a strong enough statement. Mr. <br />Ollendorff said that Bi-State must apply for a permit before any work is <br />done. The permit process includes strong reconstruction assurances of <br />torn up property. Mr. Wagner doesn't doubt that the permit process will <br />do this, but he would feel better if stronger language would be included in <br />the ordinance. <br /> <br />Don Karban, Jacobs Civil Engineering, confirmed that in terms of <br />landscaping, finishes, sidewalks, etc., that must be torn down, they, as the <br />contractors, must restore any facilities to equivalent or better appearance <br />or condition. <br /> <br />Mr. Wagner moved amendment of bill # 8651 to add the following <br />sentence to the end of Section IV. "All easements must be restored to <br />equivalent or better condition." Mr. Munkel seconded the motion to <br />amend, which carried unanimously. <br /> <br />Secondly, he wanted to be assured that the Big Bend Station required the <br />same attention to architectural details as the Forsyth station is receiving. <br /> <br />2 <br /> <br /> <br />
