exercise of such powers, functions and duties by the community itself or by the housing <br />authority, if one exists or is subsequently established in the community, and in such event, the <br />community or housing authority, as the case may be, shall be vested with all the powers, <br />functions, rights, duties and privileges of a land clearance for redevelopment authority under this <br />law; <br />(2) The governing body of a community shall not adopt a resolution or ordinance pursuant to <br />subdivision (1) above unless it finds: <br />(a) That one or more blighted, or insanitary areas (as herein defined) exist in such community, <br />and <br />(b) That the redevelopment of such area or areas is necessary in the interest of the public health, <br />safety, morals or welfare of the residents of such community. <br />(L. 1951 p. 300 § 4) <br />Board of commissioners--appointment--qualifications--terms. <br />99.340. 1. When the governing body of a municipality adopts a resolution or ordinance as <br />aforesaid, it shall promptly notify the mayor of such adoption. If the resolution or ordinance <br />adopted is one approving the exercise of powers hereunder by a land clearance for <br />redevelopment authority, the mayor shall appoint a board of commissioners of such authority <br />which shall consist of five commissioners, and when the governing body of a county adopts such <br />a resolution, said body shall appoint a board of commissioners of the authority created for such <br />county which shall consist of five commissioners. <br />2. All commissioners of an authority shall be taxpayers who have resided for a period of five <br />years in, in the case of a municipality, the area within the municipality; and, in the case of a <br />county, the area within the county. <br />3. Two of the commissioners who are first appointed shall be designated to serve for terms of <br />one year from the date of their appointment and three shall be designated to serve for terms of <br />two, three and four years respectively from the date of their appointment. Thereafter, <br />commissioners shall be appointed as aforesaid for a term of office for four years except that all <br />vacancies shall be filled for the unexpired term. <br />(L. 1951 p. 300 § 4, A.L. 1997 H.B. 689) <br />Board of commissioners--meetings--quorum--employees. <br />99.350. 1. The powers hereunder vested in each land clearance for redevelopment authority shall <br />be exercised by the board of commissioners thereof. A majority of the commissioners shall <br />constitute a quorum of such board for the purpose of conducting business and exercising the <br />powers of the authority and for all other purposes. Action may be taken by the board upon a vote <br />of a majority of the commissioners present, unless in any case the bylaws of the authority shall <br /> <br />
