INTRODUCED BY: __________ DATE: __________ <br />BILL NO. __________ ORDINANCE NO.__________ <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE <br />OF THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY <br />REPEALING SECTION 34-55(1)(4)(c) THEREOF RELATING TO SETBACK <br />REQUIREMENTS FOR AIR CONDITIONING UNITS, AND ENACTING IN <br />LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34- <br />55.1(4)(c)," BY AMENDING SAID SECTION SO AS TO CHANGE THE <br />DISTANCE FROM 2 FEET TO 1 FOOT; CONTAINING A SAVINGS <br />CLAUSE AND PROVIDING A PENALTY. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br />WHEREAS, at its meeting held at City Hall at 6:30 p.m. on March 26, 2008, the <br />University City Plan Commission recommended an amendment of Section 34-55.1(4)(c) of the <br />University City Zoning Code by adding provisions that change the setback requirement from 2 <br />feet to 1 foot; and <br />WHEREAS, due notice of public hearings to be held by the City Council in the City <br />Council Chambers at City Hall at 6:30 p.m. on _____________________________, was duly <br />published in the _____________________________, a newspaper of general circulation within <br />said City; and <br />WHEREAS, said public hearings were held at the time and place specified in said notice, <br />and all suggestions or objections concerning said amendment were duly heard and considered by <br />the City Council; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 34 of the Municipal Code of the City of University City, <br />Missouri, relating to zoning is hereby amended by repealing Section 34-55.1(4)(c), relating to <br />setback requirements for air conditioning units, and enacting in lieu thereof a new section to be <br />known as "Section 34-55.1(4)(c)," by amending said section so as to change the setback from 2 <br />feet to 1 foot, as so amended shall read as follows: <br />. <br />34-55.1 General setback exceptions <br />Every part of a yard between the property lines and the required building setback line shall <br />be unoccupied and unobstructed by any structure or portion of a structure from ground <br /> <br />
