Staff recommends approval of the Special Use Permit. <br />All density and dimensional requirements for the “GC” District are met by the proposal. The <br />Zoning Code requires 1 space for each 3.5 seats in the main assembly hall. The application <br />states the church will have seating for 300 persons in the main sanctuary area. The location has <br />110 parking spaces available for use by patrons and will provide 8 handicapped spaces. The <br />minimum requirements for parking are met. The use will not cause undue impacts on the <br />provision of public services such as police and fire protection, schools, and parks. The use itself <br />will benefit the community by providing community spiritual guidance for citizens in the area. <br />Recommendation: <br />It is the staff determination that the proposed use of the building complies with all applicable <br />provisions of the Zoning Code; will contribute to and promote the community welfare or <br />convenience; will not cause substantial injury to the value of neighboring property; is consistent <br />with the Comprehensive Plan, and will provide off-street parking and loading areas in <br />accordance with the standards contained in Article 7 of the Zoning Code. <br />Accordingly, the proposal is recommended for approval with the following condition: <br />1. Service attendance is limited to no more than 385 patrons (per the provided 110 spaces <br />and the parking ratio of one space per each 3.5 seats in the sanctuary). This restriction is <br />strictly limited to zoning code parking requirements that are determined by the number of <br />seats in the main assembly hall. This restriction does not preempt or invalidate any <br />greater restrictions on maximum occupancy per safety, building code or fire code <br />regulations that may apply. <br />2. The height and mass shall be restricted to that shown on the final approved conditional use <br />permit application plans. Except as noted below, the building and property shall be <br />developed, constructed and maintained in compliance with the plans submitted with the <br />approved application. <br />3. A final detailed landscaping plan shall be submitted to the Director of Community <br />Development for approval, in conjunction with a review by the City Forester. Landscaping <br />shall meet the requirements of Section 34-92.6 of the Zoning Code. Landscaping shall be <br />installed and maintained in accordance with the approved plan. Said landscaping plan shall <br />be finalized prior to issuance of the occupancy permit and shall be installed prior to issuance <br />of the occupancy permit. It shall be the applicants responsibility to obtain those approvals <br />ã <br />in written form in a timely manner prior to issuance of the occupancy permit. <br />4. Lighting of all exterior areas shall comply with the requirements of Section 34-93.7 of the <br />Zoning Code, and shall be designed to be compatible with surrounding areas by shading to <br />direct light downward and away from abutting residential uses. <br /> <br />
