L. CITIZEN COMMENTS
Jan Adams, 7150 Cambridge Ave
Ms. Adams identified herself as a new member on the Civil Service Board. She had
a question of the Council concerning who she would address from the City about
any legal matters she as a member of the commission might have.
Mr. Price and Mayor Adams suggested that any legal questions should be handled
by the Chair of the commission. Ms. Adams stated that because the commission
had not met for a long time, there was no clear member that could be identified as
the Chair. Ms. Ricci stated that in the Municipal Code, Chapter/Section 2.12.020
stated “The City Counselor shall have charge of all litigation in which the City is a
part; represent the City in all legal matters and proceedings in which the City is a
party or interested, or in which any of its officers are parties in their official capacity;
advise the City Council or any committee or member thereof, and the heads of all
departments, and all other officers and agencies of the City as to all legal questions
affecting the City’s interest; and approve as to form all ordinances, contracts, deeds,
bonds, and any other documents to be signed in the name of, or made to or with, the
City.” She stated that Ms. Adams had the authority to contact the City Attorney, but
since the attorney present at the Civil Service Board was Special Counsel, it was not
clear as it was not approved by the Council. Ms. Ricci stated that according to
Section 2.12.030 “Special counsel may be employed by the City Manager with the
consent of the Council to perform any necessary legal services for the City;
provided, however, that the City Manager whenever he or she deems it necessary or
advisable to do so, may employ special counsel to represent the City in matters in
the City court or circuit court of the county, on appeals from the City court, and pay
such compensation therefore as may be agreed upon within the limits of the budget
appropriation.” She felt that Council and Mr. Mulligan would need to discuss use of
Special Counsel. Mayor Adams disagreed with Ms. Ricci’s interpretation. Mayor
Adams told Ms. Adams to forward her letter to the staff and they would give her
disposition as to what is happening. Ms. Ricci wanted the City Clerk to record for
the record that 2.12.020 specifically states that a member of a commission has the
right to communicate with City Counselor on any item that affects the interest of the
City. She asked Mr. Mulligan to look at this ordinance.
Mr. Richard Dockett, 6844 Crest Ave.
Mr. Dockett was present to raise concern with the Board of Commission of MSD. He
stated the three of the commissioners are appointed by the County Executive,
Charles Dooley and the other three are appointed by the Mayor of the City of St.
Louis, Francis Slay. He expressed his concern over MSD’s disregard for the citizens
of University City. Mr. Dockett said that MSD is negating their responsibility to the
River DesPeres. He stated that MSD had assured him that they would give a report
on the condition of the River DesPeres and the action plan they have. Mr. Dockett
had not seen that report yet. He suggested the City and its citizens need to contact
Mr. Dooley with their concern over the Commissioners he elected.
Stefany Brot, 8145 Cornell Ct
Mr. Brot thanked Mr. Price for asking the Council to approve the $1,000 from the
General Fund to replace the $1,000 from the CDBG Grant that was denied. Ms.
Brot handed out reports from the treasurer of the Sutter Meyer Society and asked
the Council to help support the upcoming raffle.
