INTRODUCED BY: Mr. Wagner DATE: December 8, 2008 <br />9016 <br />BILL NO.: ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE UNIVERSITY CITY MUNICIPAL <br />CODE, RELATING TO ZONING, BY REPEALING SECTION 34-123.1 THEREOF <br />RELATING TO CITY COUNCIL REVIEW OF SITE PLANS AND SECTION 34-132.2 <br />THEREOF RELATING TO PLAN COMMISSION FINDINGS OF FACTS FOR <br />CONDITIONAL USE PERMIT APPROVAL, AND ENACTING IN LIEU THEREOF NEW <br />SECTIONS TO BE KNOWN AS "34-123.1 CITY COUNCIL REVIEW”; AND "34-132.2 <br />FINDINGS OF FACT", THEREBY AMENDING SAID SECTION SO AS REQUIRE <br />THAT ALL NEW DEVELOPMENT AND SUBSTANTIAL REDEVELOPMENT ALONG <br />OLIVE BOULEVARD REVIEWED UNDER A SITE PLAN OR A CONDITIONAL USE <br />PERMIT PROCESS COMPLY WITH THE OLIVE BOULEVARD DESIGN GUIDELINES; <br />CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br />WHEREAS, at its meeting held at City Hall at 6:30 p.m. on November 12, 2008, the <br />University City Plan Commission recommended an amendment of Section 34-123.1 and Section <br />34-132.2 of the University City Municipal Code so as to require that all new development and <br />substantial redevelopment along Olive Boulevard comply with the Olive Boulevard Design <br />Guidelines; and <br />WHEREAS, due notice of a public hearing to be held by the City Council in the City <br />Council Chambers at City Hall at 6:30 p.m. on January 5, 2009, was duly published in the St. <br />Louis Countian, a newspaper of general circulation within University City, Missouri on <br />December ___, 2008; and <br />WHEREAS, said public hearing was held at the time and place specified in said notice, <br />and all suggestions or objections concerning said amendment were duly heard and considered by <br />the City Council. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 34 of the University City Municipal Code, relating to zoning, is hereby <br />amended by repealing Section 34-123.1 thereof relating to city council review of site plans, and <br />Section 34-132.2 thereof relating to plan commission findings of facts for conditional use permit <br />approval, and enacting in lieu thereof new sections to be known as "34-123.1 City council <br />review", and "34-132.2 Findings of fact", thereby amending said sections so as to require that all <br /> <br />
