February 4, 2009 <br />Ms. Joyce Pumm, City Clerk Re: Application for Conditional <br />City of University City Use Permit P080027 <br />6801 Delmar Boulevard 1040 North and South <br />University City, MO 63130 <br />Dear Ms. Pumm: <br />At its regular meeting on January 28,2009 at 6:30 p.m. in the Emergency Operations Center of <br />City Hall, 6801 Delmar Boulevard, the City Plan Commission conducted a public hearing on an <br />application by Eric J. Walker for a Conditional Use Permit to allow the premises at 1040 North and <br />South to be used as a facility for an auto detailing operation. <br />The Plan Commission determined that the evidence presented supports the conclusion that the <br />proposed conditional use: a) Complies with all applicable provisions of chapter 34 of the <br />University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Complies with the overall neighborhood development plan and existing <br />zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas <br />in accordance with the standards contained in the University City Zoning Code. A motion was <br />made by Mr. Halpert, seconded by Mr. Miller, and passed by a vote of 5 to 1 that the Plan <br />Commission recommends approval of the application for a Conditional Use Permit subject to the <br />following conditions: <br />1. The operator shall regularly police the site and the area adjacent to the building to remove <br />litter and debris. <br />2. Trash containers for patron use shall be available on the premises at all times. Adequate <br />refuse disposal shall be provided by and for the business. The refuse containers and <br />surroundings shall be maintained in a clean condition. <br />3. The hours of operation shall be limited to those between the hours of 8 a.m. and 7 p.m. <br /> <br />
