Mr. Rose said that the Lion's are not prevented in obtaining a peddler's license. <br />They would just need to meet the criteria, such as being sponsored by a restaurant, not <br />a grocery store. Mr. Ware said that most of the major supermarkets cook as much food <br />on the inside as they do selling groceries. Putting these outdoor sales applicants only <br />outside of restaurants is not as indicative as it used to be. <br /> <br />Mr. Lieberman asked Mr. Salarano why the barbeque's were not continued on <br />Chaney's lot. Mr. Salarano explained why they no longer are at Chaney's. <br /> <br />Mr. Schoomer moved to direct the City Manager to implement option #3 permitting <br />peddler licenses to be issued to businesses for on premise sales as of the memo from <br />Gregory Rose dated October 17'h, 1997. Mr. Ware seconded the motion, which carried <br />unanimously. <br /> <br />Mr. Schoomer said that this question should continue to be studied to discover any <br />better ways to resolve it. <br /> <br />AGENDA ~ - DELCREST COURT - ACCEPTANCE AS PUBLIC STREET: <br /> <br />Mr. Ollendorff said that the Delcrest Condominium Association has requested that the <br />City take over their private street. They understand that the street has to be brought up <br />to City standards before it can be taken over as a public street. The Association <br />requests that the Council consider any type of financial support that might be available <br />for this project. Mr. Ollendorff could not find any logical basis for such support since <br />this is a private street. After checking with several neighboring communities, Mr. <br />Ollendorff said that Olivette was in the process of taking over a number of private <br />streets. Here, as in Clayton, the full costs of taking over a private street are to be born <br />by the private property owners. Council should take a look at this to see if any <br />adjustments to this policy should be made. The City Council could offer to finance the <br />improvements through a special tax bill. The costs could be spread over several years <br />at the property owners option. <br /> <br />Mr. Lieberman asked if the special tax billing could be applied even if the private <br />subdivision did the work themselves instead of the City doing the work. Mr. Ollendorff <br />replied that the City would do the work and it would have to be with the understanding <br />that the property would be accepted by the City pending the work. Interest rates are <br />approximately eight percent and the loan could be spread over a ten year period. <br /> <br />Mr. Munkel asked Mr. Ollendorff what his estimates were as to the continued costs to <br />the City once the street is improved. Mr. Ollendorff replied that once it is accepted as a <br />public street, the maintenance is the City's responsibility, which includes tree planting, <br />snow removal, asphalt repairs, and so on. <br /> <br /> <br />
