Session 1934 <br />September 20, 2004 <br /> <br />coming Thursday featuring the candidates for the office of County Executive. <br /> <br />Mr. Ollendorff asked members of the Council to add items to his agenda list if <br />they had them. <br /> <br />Mayor Adams then mentioned a vacant property near Midland and Delmar <br />Boulevards. A citizen has taken an option on the property and wants it rezoned <br />from single-family residence to a Iow-impact business for a real estate office, <br />which could revert to a private residence if his business changes. Some Council <br />discussion as to the viability of this suggestion followed, especially as it relates to <br />becoming a commercial property. Mayor Adams mentioned this to advise the <br />Council, as per their earlier request to be informed of business proposals. <br /> <br />Mr. Ollendorff mentioned the "Greensfelder lot split" issue which will be <br />discussed at the Council meeting on Monday, September 27th. Mr. Sharpe said it <br />would be helpful to understand the Plan Commission opposition to the project <br />and he was advised to view the site for additional understanding. Mr. Ollendorff <br />said they meet all the requirements, so it will be difficult to deny the request. The <br />Council can only enforce the City Zoning and Subdivision rules. Mr. Ollendorff <br />suggested the Council may want to hold an Executive Session to hear from the <br />zoning attorney prior to making this decision because it could result in litigation, <br />an expensive proposition. Discussion as to how to approach this issue followed. <br />Mr. Sharpe asked if the Council must make a decision at the forthcoming Council <br />meeting but was advised that if the Council wanted to move forward then the <br />action required was "asking for a bill to be prepared." Mayor Adams explained <br />the legal ramifications of moving forward with this suggestion and focused upon <br />the City's liability in the transaction. <br /> <br />ADJOURNMENT <br /> <br />Mayor Adams adjourned the meeting at 10:00 p.m. <br /> <br />Leisha Meine Forsythe <br />City Clerk <br /> <br />Page 7 <br /> <br /> <br />
