Session 1937 <br />October 11,2004 <br /> <br />received from any member of Council, so you are done with it and the Plan is in effect. <br /> <br />Mr. Wagner said there is "nothing magic" about the 45 days and ordinance said the <br />committee can add to or change the five-year plan at will. He made comments earlier <br />and would like to pass on two observations of the Committee now: 1) Section G - add <br />that no personal names will be included in the CALOP credits and 2) Section L - all <br />contacts or meetings attended in the name of CALOP shall be approved and reported to <br />the Chair for notification to the committee. Mayor asked for clarification on the first item <br />and Mr. Wagner said that CALOP provides grants to independent film makers to make <br />30 minute films and there is a requirement to put CALOP's and University City's logo on <br />the work. What happens is that personal names are being inserted and this measure is <br />to prevent that from happening. Mayor Adams asked for further explanation at a later <br />date. Mr. Wagner reiterated what he said previously. Ms. Welsch supported the move <br />to put this on the agenda because there had been some question in the committee as to <br />whether the Council approved of the Five Year Plan. She is pleased to know that the <br />Five Year Plan is officially in effect and cannot be questioned. Mayor Adams said his <br />understanding was "that if we did not comment it was acceptable." Ms. Welsch said the <br />Mayor is correct but that point was not made clear to the committee. Her understanding <br />is that this makes the plan official. Mr. Wagner wanted to add to the public record that <br />the City Council endorsed this version of the Five Year Plan and gave official notice to <br />the committee who did not understand this. Mayor Adams recommended that whenever <br />a Council Liaison devises a five year plan that person makes sure that it appears on the <br />Council agenda for Council consideration so there will be no confusion in the future. <br /> <br />Mr. Sharpe noted that the Five Year Plans received previously and tonight could be <br />different, and Mayor Adams advised they were the same. Ms. Welsch said the one the <br />Council approved was dated April 2004. Mr. Ollendorff said that a draft was sent to the <br />Council in March, followed by a revised draft in April, and in May the final plan which <br />was adopted and enforced was forwarded to Council as the "final plan" if members <br />chose to comment within 45 days. Mr. Ollendorff said the same plan was sent a second <br />time, but it is the same plan. Mr. Wagner said he had tried to submit the plan to the <br />agenda previously but was told that the city staff liaison had not submitted the plan for <br />approval and confusion resulted. The committee believed the staff would pass this on <br />to Council for approval and now we know that Council does not have to approve it. The <br />confusion was not all on the part of the committee but in the communication to the <br />Council. <br /> <br />Ms. Welsch added that in this Five Year Plan the CALOP commission has asked the <br />Council to consider some changes to the CALOP ordinance, which she will write and <br />submit for suggestions. She wants to respond to the request to the CALOP commission <br />that numbers in the commission be increased from five to seven members. Mr. <br />Ollendorff said he was aware of this desired change so he asked the City Attorney to <br />draft a bill which could be introduced tonight if Council wants to do so.
