Session 1937 <br />October 11,2004 <br /> <br />University City: Firstly, it is received by the Plan Commission to see if it meets the <br />Zoning Ordinances and secondly, the Plan Commission makes recommendations to the <br />City Council to approve a permit for any cell phone tower anywhere in University City. <br />In this case, a second set of approvals are needed for a proposal located on City <br />property and this is from the Park Commission which must review the plans. The Park <br />Commission is currently considering the proposal tabled until the October meeting <br />because more information was needed. A conclusion from the Park Commission is <br />anticipated in October. The earliest the City Council can review the proposal is in <br />November. If the Heman Park cell phone tower is approved, it goes to the Plan <br />Commission and the process begins again. The City Council will want comments from <br />the public hearing relayed to the Planning Commission and to the Park Commission. <br /> <br />Mr. Wagner thanked the audience for coming tonight to share their concerns on this <br />issue. The public has expressed many concerns about this proposal. He then requested <br />that the city attorney thoroughly study the case law surrounding this issue and the <br />restricted number and placements of cell phone towers in other local municipalities. He <br />requested the City Manager to report on these findings to the Council well before the <br />Council is asked to make any decisions. <br /> <br />Councilmember Welsch thanked the residents for their comments and said she will <br />consider the appointment of the recommended task force. She said that she "wants to <br />go on record as saying" that she does not appreciate the federal government taking <br />authority away from the City to discuss potential health impacts, negative or positive, on <br />cell phone towers. There are sufficient arguments against placement of the cell phone <br />tower for aesthetic values and the loss of green space. She would hate to see one <br />square foot of our precious green space lost to the placement of a cell phone tower. <br /> <br />A,qenda Item #3 - Public Hearinq - 9009 Old Bonhomme Riqht-of-Way Vacatin,q <br /> <br />The City Council has been set at this time and place to hear comments on the <br />requested vacating of public right-of-way north of Old Bonhomme Road between <br />numbers 9099 and 9011.
