Session 172 I, Minutes 10 <br />May 4, 1998 <br /> <br />GRANTED BY, AND SUBJECT TO, THE PROVISIONS OF THE COMPENSATING <br />USE TAX LAW, SECTIONS 144.600 RSMO, ET SEQ.; PROVIDING FOR THE USE <br />TAX TO BE REPEALED, REDUCED OR RAISED IN THE SAME AMOUNT AS ANY <br />CITY SALES TAX IS REPEALED, REDUCED OR RAISED; CHOOSING THE <br />METHOD OF LOCAL USE TAX DISTRIBUTION AS REQUIRED UNDER SECTION <br />144.757 RSMO, SO THAT THE TAX MONEY SHALL BE DISTRIBUTED TO THE CITY <br />BASED ON THE PERCENTAGE RATIO THAT ITS POPULATION BEARS TO THE <br />TOTAL POPULATION OF ALL MUNICIPALITIES CHOOSING THE SAME OPTION; <br />AND REPEALING ORDINANCE NO. 6161 AND THAT PART OF ORDINANCE NO. <br />6144 WHICH SETS THE RATE AT ONE AND ONE-HALF OF ONE PERCENT (1 ½ <br />%); CONTAINING AN EMERGENCY CLAUSE. <br /> <br />Mr. Wagner moved adoption. Mr. Schoomer seconded the motion. The roll call vote <br />was as follows: AYES: Mr. Wagner, Mr. Lieberman, Mr. Schoomer, Mr. Sharpe, Mr. <br />Colquitt, Mr. Munkel and Mayor Adams. NAYS: none. Bill No. 8386 became Ordinance <br />No. 6164. <br /> <br />CITIZEN COMMENT: <br /> <br />Mr. David Kennell, 1332 Purdue, said that a neighbor behind him recently cut down <br />some big trees and signed a three year contract with AmerenUE to put in a very <br />powerful floodlight, about twenty-five feet off the ground. The light from it goes through <br />his windows, including the bedroom windows, interfering with his sleep. He has spoke <br />with Mr. Sharpe and Mr. Ollendorff about this situation. AmerenUE told him that the <br />customer has the freedom to put in such a light. He wanted to find out if the City had <br />any ordinances that would protect him from this kind of nuisance. <br /> <br />Mr. Schoomer asked Mr. Ollendorff if Council passed legislation last year requiring that <br />such lights be screened from surrounding residences. Mr. OIlendorff said yes this was <br />true, however, Mr. Kennell was not satisfied with this screening. <br /> <br />Mayor Adams told Mr. Kennell that this is a choice of this resident to put this light up. <br />Council can control this choice little with residential property, definitely much more with <br />commercial. <br /> <br />Mr. James Kline, 1276 Hafner Place, said he was a member of the Lion's Club. He said <br />they had a fund-raising barbeque scheduled for Saturday, May 2®, and the Police <br />Department terminated their efforts to hold a barbeque. They were under the <br />impression that they could continue with their fund-raising. <br /> <br />Mr. Wagner asked where the barbeque was held. Mr. Kline said at the National's on <br />Olive at Hanley. <br /> <br /> <br />
