Session 1724, Ninutes 13 <br />May 18, 1998 <br /> <br />BILL NO. 8385 - AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTION 34-57.3 <br />THEREOF, RELATING TO ELEVATOR APARTMENT BUILDINGS AND ENACTING IN <br />LIEU THEREOF A NEW SECTION 34-57.3, "ELEVATOR APARTMENT BUILDINGS," <br />SO AS TO AMEND SAID SECTION RELATING TO DEVELOPMENT LOCATION AND <br />RELATING TO MINIMUM BUILDING SETBACKS; BY REPEALING SECTION 34-57.4, <br />RELATING TO COMMON OPEN SPACE REQUIREMENTS FOR RESIDENTIAL <br />DEVELOPMENTS, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE <br />KNOWN AS SECTION 34-57.4, "COMMON OPEN SPACE REQUIREMENTS FOR <br />RESIDENTIAL DEVELOPMENTS" SO AS TO AMEND SAID SECTION RELATING TO <br />THE STANDARD FOR DEVELOPMENTS IN THE HIGH DENSITY RESIDENTIAL OR <br />THE HIGH DENSITY RESIDENTIAL/OFFICE DISTRICTS, RELATING TO THE <br />MINIMUM AREA FOR COMMON OPEN SPACES AND RELATING TO OTHER <br />REQUIREMENTS FOR SUCH COMMON OPEN SPACES; CONTAINING A SAVING <br />CLAUSE AND PROVIDING A PENALTY.~ <br /> <br />Ms. Nancy Holekamp, #19 Willow Hill Rd., said that bill #8385 has Gatesworth written <br />all over it and if it didn't, Mr. Deutsch and Mr. Smith would not be here tonight. <br />Obviously, you have heard us and you know we are right. The current building does <br />not meet code and you are afraid of a lawsuit. She asked what the purpose of having a <br />code was if it was not going to be followed. The entire Zoning Code is being changed <br />from this point forward for one building. She realizes if the City is going to change the <br />code, then she has no recourse but to appeal to Council's moral and ethical obligations. <br />She said that the Gatesworth is being allowed to be railroaded through. She said that <br />she would be asking for a copy of the Plan Commission March 25~h minutes tomorrow <br />morning, and she better had see every single change discussed at the meeting, <br />because if not, there had been a procedural violation. She suggests that this bill be <br />tabled tonight. She thinks the State Attorney's office would be very interested in this <br />situation. <br /> <br />Ms. Ann Byrnes, #18 Willow Hill Rd., said that she was here a couple of weeks ago <br />when this bill to change the zoning code was introduced. She said that the Mayor and <br />other Councilmembers were sworn in that evening and part of the oath was for each of <br />them to uphold the codes of University City. The changes to the brand new zoning <br />code are being made strictly for the Gatesworth expansion. She knows that speaking <br />against this probably will not do any good, but she can not sit by silent as this injustice <br />is carried out. <br /> <br />Ms. Wendy Katz, 8708 W. Kingsbury, said she was speaking on behalf of her mother <br />and her grandmother, who is recovering from an illness and lives at 8672 W.
