Session 1724, Minutes <br />May 18, 1998 <br /> <br />Mr. Schoomer asked that this also be sent to all those people that signed the petition <br />and that they be invited to pass the information on to others that they feel would be <br />interested. <br /> <br />Mr. Schoomer moved to set the public hearing. Mr. Munkel seconded the motion. <br /> <br />Mr. Wagner asked the City Manager to report on how long this restaurant has actually <br />been operating. Mr. Ollendorff replied that he did not have specific information with <br />him, but that the applicant was present and could answer the question. Mr. Wagner <br />said that he would oppose this, because he feels that the applicant should wait a full six <br />months. <br /> <br />Mr. Munkel asked the City Manager to provide the Council with any violations or police <br />calls at this location, pdor to the proposed public hearing. <br /> <br />Mr. Lee Tyson, 7347 Trenton, said that Mr. Montgomery's establishment was clean and <br />the food was good. He has known Mr. Montgomery for some time and feels him to be <br />a fine individual. He is trying to attract good, upstanding citizens to his establishment. <br /> <br />Upon Mr. Wagner's request, Mayor Adams asked for the applicant to come forward. <br /> <br />Mr. Anthony Montgomery, 1525 Nixon & 1255 Ferguson, responding to Mr. Wagner, <br />said that he had been open since approximately the second week of February. He has <br />been opened six days a week since then. <br /> <br />The motion carried six to one to allow the public hearing. Mr. Lieberman voted Nay. <br /> <br />AGENDA ~, - PUBLIC HEARING - BENLOU STREET VACATING: <br /> <br />Mr. Ollendorff said that a public hearing had been set for 7:30 p.m. this date and place <br />to hear any comments on the proposed vacating of the portion of Benlou going north <br />from Stanford for one-half of a block. There is no apparent need for this public right-of - <br />way. The family owning both sides of this property wish to use it as an extension of <br />their yard. Vacating would relieve the City of future maintenance expense and liability. <br />If vacating appears to be in order, Council may request preparation of an ordinance to <br />carry out this action. <br /> <br />Mayor Adams opened the public hearing. <br /> <br />Ms. Caroline deforest, 7901 Stanford, said that she owned the property at 7849 <br />Stanford as well. This piece of land has been the driveway for the home that she lives <br /> <br />5 <br /> <br /> <br />
