It may even be a misuse of Council time to <br />approve a plan of which an element is the vacating of an area which has not been <br />vacated. Would it not make sense at this time to postpone this, so that proper <br />notification of vacating has taken place. It seems to make more sense to approve the <br />vacation first, before approving the conditional use permit. The Traffic Commission is to <br />meet in two days about the Barby Lane situation, in addition to the notice to vacating <br />the street, would it not be possible to consider postponing the decision on the <br />conditional use until the Traffic Commission has heard the Barby situation. About <br />vacating West Kingsbury, we know that there has been a series of public hearings and <br />street vacations in the past, as well as McKnight. From her research she determined <br />that West Kingsbury is a very old street. Mr. Walker gave her a copy of a site plan, but <br />he was not sure if it was current. The neighborhood wants a current site plan before <br />the conditional use permit is voted on. Mr. Ollendorff had told her that the landscaping <br />plan was not ready. She asked about the grading study. Mr. Ollendorff said it had to <br />be approved by MSD and the Public Works Department. They do not understand the <br />process of what happens after the conditional use permit is approved, when conditions <br />have not yet been met. She handed pictures to the City Clerk for viewing by the City <br />Council. She mentioned her concerns about the huge trees that will have to be <br />removed because of the construction. She asked that underground parking be <br />considered in order to preserve the dense tree cover. She also voiced concern that, <br />looking through Council minutes dealing with the Carleton Manor development, that so <br />much discussion was generated by Council and virtually none with the much larger <br />Gatesworth development. <br /> <br />Daniel Talonn, 8661 Barby Lane, said that it would be prudent to postpone the <br />conditional use permit until more facts are available. The Traffic Commission will meet <br />in a couple of days to consider an application by citizens to close off the east end of <br />Barby Lane, where it intersects McKnight Place. The street has many problems now <br />which will escalate with the expansion. He understands that the zoning requirement <br />states that 30% of a multi-story building must be on a major street, which in this case is <br />I-170. The problem is that there is no communication from the interstate to the <br />Gatesworth or vice versa. The only major street is Delmar, which is a block away. The <br />traffic situation here should be studied. <br /> <br />Ann Byrnes, #18 Willow Hill, said that a vote of the conditional use should not be <br />attempted without the grading survey, which has not been completed. The results <br />could change the whole layout of the plan. Once the permit is issued, the Council loses <br />control. She asked about other conditions, and whether they have been met. <br />Councilmembers should be actively making sure these conditions are met, before <br />voting on the conditional use permit. <br /> <br /> <br />
