<br />Regular meeting <br />May 23, 2005 <br /> <br />The Mayor responded that the City Manager is suggesting that for tonight, we introduce <br />it as originally submitted. At the next Council Meeting, prior to the second and third <br />reading, the Council can make a decision whether or not to keep subparagraph C, <br />under paragraph 4. No action is on the bill is settled until after the third reading and <br />vote of the Council at the next meeting. Ms. Brot thanked the Mayor for his explanation. <br /> <br />Ms. Welsch asked if we leave the bill as is, then the Council could give a beer and wine <br />license now to the Tivoli and then at some undetermined time in the future could have <br />the authority to change it to a full liquor license. Mr. Ollendorff said that she was <br />correct. Mayor Adams said that we could reissue a new license without the need of <br />amending the ordinance again. <br /> <br />Mr. Wagner wanted to find out the best way of dealing with liquor not being sold at the <br />late night show. Mr. Ollendorff said that this is not part of the ordinance, but feels that it <br />would be a condition of the license. He will confirm this with the city attorney, but as he <br />recalls, Council may not add conditions to a liquor license. Licensing must model state <br />law. Mayor Adams said that he was correct. Mr. Ollendorff said that you can suggest <br />the applicant to voluntarily impose restrictions on themselves. Mr. Wagner asked why it <br />couldn't be a condition on the license. Mr. Ollendorff said that the applicant is on record <br />that if the Council grants this license, they accept the following restrictions. Mr. Wagner <br />is not satisfied with voluntary; he much prefers a mandatory condition. Mr. Ollendorff <br />says he understands that and will clarify his understanding with the city attorney and <br />report back to Council. In the past, the city attorney has advised that the City Council <br />does not have the authority under state law to add conditions to liquor licenses, but you <br />do have the authority to accept voluntary restrictions offered by the applicant. Mr. <br />Wagner stated that a voluntary commitment is not worth the paper it is written on. <br /> <br />4. Ms. Colquitt introduced Bill Number 8788: <br /> <br />AN ORDINANCE APPROVING A FINAL SUBDIVISION PLAT OF A TRACT OF <br />LAND TO BE KNOWN AS "THE VILLAS AT FOUNTAIN PLACE <br />CONDOMINIUMS - LOTS 4 AND 7" AND LOCATED AT 8001 - 3 AND 8010- <br />12 PRESIDIO COURT. <br /> <br />5. Ms. Welsch introduced Bill Number 8789: <br /> <br />AN ORDINANCE APPROVING A FINAL SUBDIVISION PLAT OF A TRACT OF <br />LAND TO BE KNOWN AS "761 SYRACUSE CONDOMINIUMS" AND LOCATED <br />AT 761 SYRACUSE. <br /> <br />Miscellaneous Comments: <br /> <br />Ms. Welsch asked if our new IT person was involved intricately in the data cabling <br />previously approved under the Consent Calendar.
