<br />RESOLUTION <br /> <br />RE5~fIOO5~ <br /> <br />The matter ofthe preliminary development plan for 7201 Balson and 965 <br />Midland, in the City of University City, Missouri, was considered. <br /> <br />~review and genernl discussion of the matter, Councilmember <br />offered the following resolution and moved its adoption. <br /> <br />BE IT RESOLVED: That the Council of the City of University City, Missouri, <br />finds and declares as follows: <br /> <br />1. Section 34-40.14.2 of the University City Municipal Code requires that a <br />preliminary development plan be approved simultaneously with the <br />adoption of an ordinance rezoning a site to Planned Development- <br />Residential ("PD-R"). <br /> <br />2. The preliminary development plan for 7201 Balson and 965 Midland, <br />known as "Heman Park Condominiums", is hereby approved. See <br />Conditional Use Permit P040011; and Ordinance NoJd:g~'rezoning the <br />property to PD-R. <br /> <br />3. The following land uses and developments maybe permitted in the PD-R <br />district, subject to the issuance of a conditional use permit: Dwellings, <br />Garden Apartments. The following conditions shall be in the conditional <br />use permit: <br /> <br />1. Minimum lot size shall be reduced, to below 2 acres as <br />proposed in the application. <br />2. The standards for common open space shall be reduced to <br />those as proposed in the application. <br />3. The building and property shall be developed, constructed <br />and maintained in compliance with the plans submitted <br />with the approved application. The height and mass shall <br />he restricted to that shown on the application plans. <br />4. A detailed landscaping plan shall be submitted to the <br />Director of Planning for approval, in conjunction with a <br />review by the City Forester. The landscaping plan shall <br />include a buffer of large caliper trees along the south, west <br />and east property lines to help screen the development <br />from abutting properties. Air conditioning units shall be <br />screened with a dense evergreen landscaping to create a <br />buffer. Landscaping shall be installed and maintained in <br />accordance with the approved plan. Said landscaping plan <br />shall be finalized prior to the first residential occupancy <br />permit being approved. <br />5. Lighting of all exterior areas, including the front parking <br />
