<br /> <br /> <br /> <br /> <br /> <br /> RESOLUTION 2009-1 <br /> <br /> <br /> The matter of the neighborhood improvement district in University Hills was considered. <br /> <br /> <br /> After a review and general discussion of the matter, Councilmember Crow offered the following <br /> resolution and moved its adoption. <br /> <br /> <br /> BE IT RESOLVED: That the Council of the City of University City, Missouri, finds and declares as <br /> follows: <br /> <br /> <br /> <br /> 1. On November 6, 2006, a neighborhood improvement district in University Hills Subdivision (the <br /> "Subdivision") was lawfully established by Resolution 2006-07, and preliminary plans and <br /> specifications for the proposed improvement were ordered to be made. <br /> 2. The general nature of the proposed improvement was as follows: <br /> a) Repair and replacement of curbs, gutters and driveway aprons that were significantly <br /> damaged, non-functional or exhibit more than minor cracks, as determined by the <br /> Subdivision Trustees. <br /> b) Patching, repair and replacement of interface between the street and the concrete curbs, <br /> gutters and driveway aprons in connection with the repair and replacement of such curbs, <br /> gutters and driveway aprons and in other areas where crumbling street interface exists, as <br /> determined by the Subdivision Trustees. <br /> c) Selected street patching, repair and resurfacing of depressions, fatigue failure, street <br /> crowning and rutting, as determined by the Subdivision Trustees. <br /> d) Application of a new layer of chip seal to all streets, as determined by the Subdivision <br /> Trustees. <br /> e) Management and supervision of construction of the improvements listed above and <br /> maintenance of the improvements listed above during the construction period, to be <br /> performed by the Subdivision Trustees. <br /> f) Application of a future second layer of chip seal to all streets to be performed by the <br /> Subdivision Trustees, which application shall occur after payment in full of all assessments <br /> against the real property within the neighborhood improvement district but within a <br /> maximum timeframe of fifteen years. <br /> g) Establishment of a maintenance fund for the benefit of the Subdivision Trustees to provide <br /> for the application of a second layer of chip seal to all streets, which application shall occur <br /> after payment in full of all assessments against the real property within the neighborhood <br /> improvement district but within a maximum timeframe of fifteen years. <br /> <br /> 3. On February 26, 2007, by Resolution 2007-6, the proposed improvement was ordered to be made <br /> in accordance with the plans and specifications set out in "Project No. 1015" entitled "University <br /> Hills Subdivision Street Improvements" attached thereto, with a revised estimated cost of <br /> $728,000.00 <br />
