The nearest music school is located at 560 Trinity Avenue, or approximately 500 linear feet from the subject property, and in the PA-Public Activity district. This building houses music teaching, rehearsals, and many performances for the Washington University Music Department. The hours of operation of the facility are Monday through Friday, from 8:30 a.m. - 12:00 a.m., Saturday 11:00 a.m. – 7:00 p.m., and Sunday from 11:00 a.m. - 12:00 a.m. Located at 524 Trinity, or approximately 650 linear feet from the subject property, is the Center of Creative Arts (COCA).COCA offers many types of classes, including voice lessons. It is located in the PA-Public Activity district. The hours of operation vary, but the facility does not remain open after 9:00 p.m. on any night. With the imposed conditions, the proposed use is not expected to negatively impact living or working conditions in neighboring areas. The dense residential area, neighboring active commercial district and similar music educational opportunities in close proximity illustrate the community form and character of the urban area surrounding the subject property. It will be consistent with the functional mix of land uses and serve the unmet needs of independent music contractors. RECOMMENDATION Staff recommends approval with the following conditions: 1. The hours of operation shall be limited to those between 9:00 a.m. to 9:00 p.m. from Monday through Friday, and 10:00 a.m. to 5:00 p.m. on Saturday and Sunday. 2. The facility shall be operated so that noise complies with the University City Noise Ordinance (Section 9.08.240.2). Playing Radios, Etc. The playing of any radio, phonograph or other musical instrument in such a manner or with such volume as to tend to annoy or disturb the quiet, comfort or repose of persons in any dwelling, hotel or other type of residence; provided, that any such noise that can be distinctly heard at a distance of more than one hundred (100) feet from its source shall be deemed excessive. 3. No recitals shall occur on the premises. 4. No drum lessons shall be conducted after 5:00 p.m. on Monday through Friday. 5. No music or other camps shall occur on the premises. 6. All music school related activity must be operated entirely within the principal building. 7. The exterior appearance of the building shall not be altered in any manner to cause the premises to differ from its residential character. 8. No outdoor storage of materials is permitted. 9. Signage shall be restricted to one wall or window sign not to exceed four (4) square feet.
