<br />Regular meeting <br />January 09, 2006 <br /> <br />THEREOF RELATING TO SIGNS IN CONNECTION WITH POLITICAL CAMPAIGNS, <br />OTHER CIVIC NONCOMMERCIAL CAMPAIGNS, OR OTHER NONCOMMERCIAL <br />MESSAGES, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 34-104.2(5)" BY AMENDING SAID SECTION SO AS TO CHANGE <br />REQUIREMENTS FOR SIGN SIZE AND DURATION CONTAINING A SAVINGS CLAUSE <br />AND PROVIDING A PENALTY. TABLED <br /> <br />CITIZEN COMMENTS: <br /> <br />Mondi Ghasedi, 6644 Kingsbury Blvd <br />Ms. Ghasedi expressed her concern as a lawyer knowing the current sign ordinance that <br />University City has in place is unconstituitional and prevents freedom of political speech. <br />She was disappointed that this bill was being tabled. <br /> <br />James Felakos, ACLU of E. Missouri <br />Spoke on the Unconstitutionality of the Sign Ordinance of University City. Mr. Felakos is the <br />staff attorney for the American Civil Liberties Union of Easter Missouri. He has submitted <br />written comments to the City Clerk. Mr. Felakos stated that the current ordinance and the <br />proposed reform ordinance raise issues of Constitutional concern regarding political signs. <br />The concerns were (1) the limits on the duration a political sign may be displayed, (2) the <br />limits on the permitted size of the political signs and (3) the ban on illumination of political <br />signs. Mr. Felakos stated a litigated case of City of Ladue v. Gilleo and the ruling handed <br />down from this case. He also addressed the mechanism whereby the City may remove signs <br />or whether notice would be given to residents of violations. University City citizens have an <br />interest in expressing their political beliefs; the City should foster, not hinder such expression. <br /> <br />BILL NO. 8836 - AMENDING CHAPTER 2.62 OF THE UNIVERSITY CITY MUNICIPAL <br />CODE, RELATING TO THE POLICE AND FIREFIGHTER'S RETIREMENT SYSTEM, BY <br />REPEALING SECTION 2.62.020 THEREOF, RELATING TO DEFINITIONS, AND <br />ENACTING IN LIEU THEREOF, A NEW SECTION TO BE KNOWN AS "SECTION 2.62.020 <br />DEFINITIONS," THEREBY AMENDING SAID SECTION SO AS TO CHANGE THE <br />DEFINITION OF "BASE SALARY." <br />Ms. Sharpe Jr. made a motion to adopt and was seconded by Ms. Brungardt. The Roll Call <br />vote was as follows: AYES: Mr. Sharpe Jr., Ms. Brungardt, Mr. Wagner, Ms. Brot, Ms. <br />Welsch, and Mayor Adams. NAYS: none <br />Bill number 8836 passed and became Ordinance number 6604. <br /> <br />BILL NO. 8837 - MENDING CHAPTER 34 OF THE UNIVERSITY CITY MUNICIPAL CODE <br />RELATING TO ZONING, BY REPEALING SECTION 34-64.4 THEREOF, RELATING TO <br />TELECOMMUNICATIONS ANTENNAS, TOWERS AND SUPPORT STRUCTURES, AND <br />ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34-64.4 <br />WIRELESS TELECOMMUNICATIONS TOWERS, ANTENNAS, SUPPORT STRUCTURES, <br />AND BUILDINGS OR ENCLOSURES FOR THE POWER AND OPERATING EQUIPMENT <br />OF SUCH FACILITIES;" CONTAINING A SAVINGS CLAUSE AND PROVIDING A <br />PENAL TY. <br /> <br />Page 7 <br />
