Session 1734, Minutes <br />November 2, 1998 <br /> <br />Mr. Lieberman said that this store does sell various bottles for hairstyling at retail. Also <br />there is an art display for sale. He sees a corollary between this shop and Napps on <br />the east end of Delmar and he does not remember any fuss about retail with them. <br />They are very similar and, in actuality, do provide retail. <br /> <br />The motion to approve carried unanimously. <br /> <br />AGENDA NO. 5 - RESUBDIVISION OF 7937 CORNELL: <br /> <br />Mr. Ollendorff concurs with the Plan Commission recommendation to approve the <br />splitting of this lot into two parcels each of which meets all zoning ordinance <br />requirements as to size. Each of the resulting lots will also be typical of the size found <br />in this neighborhood. Approval will result in two new high quality houses where only <br />one currently exists. The new houses will be no closer to each other or to the existing <br />neighboring houses than is the situation on other properties nearby. He is told that <br />there may be some private restrictions on the use of property within this neighborhood. <br />The City does not enforce private restrictions. <br /> <br />Mr. Schoomer said that he had received on Sunday copies of the subdivision indenture <br />for the fifteen homes which comprise the Fairbrooks subdivision, which would seem not <br />to permit buildings of this nature to be erected. As the City Manager has described, <br />however, this is a private matter and the City can't enforce them. Since this proposal <br />does meet within the state requirements for resubdivision and the zoning code, there is <br />not a choice in whether or not to approve it. He would like, however, to propose to <br />table this matter until the neighbors have a chance to investigate whatever legal <br />proceedings are necessary to make their point properly heard. <br /> <br />Mr. Munkel is in agreement that if there is a legal entanglement for the use of this <br />property that the legal process should be addressed before a vote is cast on this <br />matter. <br /> <br />Mr. Sharpe asked if there were contractors willing to build on this lot. The Mayor replied <br />that there were contractors willing to build on this property. <br /> <br />Debbie Garbow, 7947 Cornell, is one of the fifteen property owners in this subdivision. <br />They are mostly concerned with the way the neighborhood is going to look, and the <br />congestion and crowding that will take place. There are no two story houses <br />sandwiched between ranch style houses anywhere in the neighborhood. There are <br />legal deed restrictions for the properties in this subdivision, which will be addressed by <br />the next speaker. <br /> <br /> <br />
