INTRODUCED BY: Mr. Price DATE: July 26, 2010 <br />90836823 <br />BILL NO.: ORDINANCE NO.: <br />AN ORDINANCE AMENDING CHAPTER 8.12 OF THE UNIVERSITY <br />CITY MUNICIPAL CODE, RELATING TO GARBAGE COLLECTION AND <br />DISPOSAL, BY REPEALING SECTION 8.12.210 THEREOF, RELATING <br />TO THE PENALTY FOR DELINQUENT SOLID WASTE COLLECTION <br />BILLS, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE <br />KNOWN AS “SECTION 8.12.210 DELINQUENT FEES; PENALTY”, <br />THEREBY AMENDING SAID SECTION SO AS TO REDUCE THE <br />INITIAL PENALTY FROM TEN PERCENT (10%) TO FIVE PERCENT <br />(5%), AND REDUCE THE MONTHLY PENALTY THEREAFTER FROM <br />FIVE PERCENT (5%) TO TWO AND ONE-HALF PERCENT (2-1/2%); <br />CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 8.12 of the University City Municipal Code, relating to garbage <br />collection and disposal, is hereby amended by repealing Section 8.12.210 thereof, <br />relating to the penalty for delinquent solid waste collection bills, and enacting in lieu <br />thereof a new section to be known as “Section 8.12.210 Delinquent fees; penalty”, so <br />that said section, as so amended, shall read as follows: <br />8.12.210 Delinquent fees; penalty. <br /> If fees remain unpaid thirty (30) days after the beginning of the service period for <br />which the bill is rendered, then such bill shall be delinquent and subject to a penalty of <br />five percent (5%). For each month the bill remains unpaid thereafter, and up to the date <br />of certification of any special tax bill pursuant to Section 8.12.240, an additional penalty <br />of two and one-half percent (2-1/2%) shall be applied to the accumulating balance of the <br />delinquent bill. <br />Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from an penalty heretofore incurred by the violation of Section 8.12.210, nor <br />bar the prosecution of any such violation. <br />Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter <br />1.12 Section 1.12.010 of the University City Municipal Code. <br />Section 4. <br /> This ordinance shall take effect and be in force from and after its passage as <br />provided by law. <br /> <br />
