REVISED 8-5-10 <br />Council Agenda Item Cover <br />__________________________________________________________________________________ <br />MEETING DATE: <br /> August 9, 2010 <br />AGENDA ITEM TITLE <br />: T-Mobile Settlement <br />AGENDA SECTION: <br /> New Business <br />CAN THIS ITEM BE RESCHEDULED? : <br />No <br />BACKGROUND: <br />T-Mobile was the final large cell phone company which had not <br />agreed to a settlement of the cell phone lawsuit regarding non-payment of gross <br />receipts tax. A settlement with T-Mobile has been preliminarily approved by the judge, <br />with distribution of funds set for approximately December 2010, if the settlement is given <br />final approval in October. Please see the attached Claim Form and settlement Notice <br />for further information. Per this notice, the City will receive zero in settlement, but will <br />move protested funds into City revenues for the amounts already held in escrow. The <br />total FY11 financial impact of this settlement is approximately $650,000 which includes <br />the settlement and also the on-going future revenue. <br />Mr. Mulligan will be present at the meeting to answer any questions regarding this <br />settlement. <br />RECOMMENDATION: <br />Approval <br /> <br />
