<br /> <br /> <br /> <br /> <br /> - Session 1318, Minutes Page 3 <br /> November 8, 1982 <br /> <br /> Mr. Levy reminded the speaker that Mr. Ross' character or the job he has done was <br /> not the issue, pointing out that Mr. Ross has been a stabilizing factor in the area <br /> without a liquor license. <br /> Mr. Adams also commented that the Council has been very consistent over the years <br /> in not issuing liquor licenses to small, neighborhood stores. In this case, he <br /> said the decision was somewhat more difficult because of the commercial aspect of <br /> the immediate area; however, the residential area was also contiguous and must be <br /> considered. The fact that the store was open so late (11:30 p.m.) was also an in- <br /> fluencing factor, in addition to having been open a relatively short time and not <br /> really having established a track record yet. <br /> The question was called, and the roll call vote was a follows: AYES: Councilmem- <br /> ber Thompson. NAYS: Councilmembers Lieberman, Adams, Metcalfe, Levy, Schoomer and <br /> Mayor Mooney. The motion was defeated by a vote of six to one. <br /> <br /> Mr. Lieberman asked Mr. Ollendorff to make certain that the beer signs in the win- <br /> dow of the All in One Food Shop were removed. <br /> RECONSIDERATION OF CONDITIONAL USE PERMIT <br /> <br /> The City Manager said the owners of the property at Delmar and Old Bonhomme request- <br /> ed that the Council reconsider the granting of a conditional use permit for a ser- <br /> vice station with mini-convenience store, denied by the'Council at its last meet- <br /> ing. He noted this matter cannot be taken up for discussion unless a member of <br /> the Council who voted in the majority requested that the matter be reconsidered. <br /> Mr. Lieberman raised a point of order, noting that the City Manager did not have <br /> the prerogative to put this matter on his agenda unless a councilmember voting with <br /> the majority asked him to do so. That was not forthcoming; therefore the matter <br /> was dropped. <br /> CONDITIONAL USE PERMIT - 6900 DELMAR BOULEVARD <br /> <br /> The City Manager recommended that a public hearing be held at 7:45 p.m. on Monday, <br /> November 22, to hear and consider comments on the proposed conditional use permit <br /> for the property formerly owned by the Greek Orthodox Church. He said the impor- <br /> tance of this development to the neighborhood and City was such that action should <br /> be taken by the City Council at the earliest opportunity. He noted that both the <br /> Council and residents of the neighborhood have expressed an interest in reviewing <br /> the details of the proposal: The Plan Commission has recommended approval of the <br /> permit with appropriate conditions, and Mr. Ollendorff concurred in that recommen- <br /> dation, adding that he would have additional comments and suggestions relating to <br /> the conditions prior to the public hearing. <br /> Mr. Lieberman moved that a public hearing be scheduled as noted above. Mrs. Met- <br /> calfe seconded the motion, which carried unanimously. <br /> REDEVELOPMENT PLAN - TAX ABATEMENT <br /> <br /> The City Manager recommended that the City Council call a public hearing for 8:00 <br /> p.m. on November 22 for the purpose of considering the redevelopment plan and tax <br />
