that the amendment Mr. Walker is suggesting will not affect the release of the money nor <br />the future tax payments. <br /> <br />Mr. Crow asked Mr. Walker what were the legal questions that still needed to be answered. <br /> <br />Mr. Walker stated that he has only been in the job for less than a month and has not had a <br />chance to go through the entire agreement and would like the opportunity to do that. <br /> <br />Ms. Ricci stated that the ordinance says that by incorporating by reference the settlement <br />agreement which the Council has not received until the weekend before and consists of <br />seventy-one pages. She said that none of the material Council was given provided what <br />the total amount of the settlement was. Ms. Ricci says the ordinance says that the City <br />waves all claims it has against T-Mobile and she is not clear as to what the City is waving. <br />She was troubled that the Council got the notice and prior administration could not tell her <br />when they received the notice even though it came by certified mail. <br /> <br />Roll Call vote on amendment offered by Mr. Kraft was: <br />AYES: Ms. Ricci, Mr. Kraft, Mr. Glickert, Mr. Sharpe, and Mayor Welsch <br />NAYS: Mr. Price, and Mr. Crow <br />The amendment carried by a majority. <br /> <br />Mr. Price stated for the record that to his understanding there can be no adjustment to the <br />payment due the City from T-Mobile and is not for any foolishness that could jeopardize this <br />kind of money. <br /> <br />Mr. Mulligan stated that if there is more or less money given to the attorney fees it would not <br />affect what is given to the City. It was his interpretation of the agreement that if the court <br />would award less, that money would revert back to T-Mobile and not to the Cities. He said <br />T-Mobile is paying the fees on top of the back taxes. <br /> <br />Mr. Glickert asked Mr. Mulligan that if he read the letter correctly, there was some verbiage <br />in it that University City was over paid and asked if the City was exposed here. <br /> <br />Mr. Mulligan said that in reference to over paid was prior to 9/1 date other cities were being <br />paid. The discussion was what should be done with the additional money U City received <br />and the outcome was that nothing would be done. <br /> <br />Mr. Crow asked what the cost was for outside Council used with this case. <br /> <br />Mr. Sharpe asked to verify that the City already had the money in escrow and Mr. Mulligan <br />confirmed it. He asked when that money could be released and Mr. Mulligan said it should <br />be release around mid December. <br /> <br />Roll Call vote on Bill 9084 with approved amendment was: <br />AYES: Mr. Kraft, Mr. Crow, Mr. Glickert, Mr. Sharpe, and Mayor Welsch <br />NAYS: Ms. Ricci and Mr. Price <br /> <br /> <br /> <br /> <br /> <br /> 4 <br /> <br />
