Mulligan was consulted and a copy of his legal opinion followed. She asked Council
members to please not put things into the letter that were not there which includes that nor
any discussion about removal from public office.

Ms. Ricci stated that she has read the resolution and Mr. Price did do everything that is
listed in it, including standing up and he was vocal, verbal, menacing and in her opinion out
of control. She said for him to now inject ulterior purposes is totally inflammatory and
inaccurate. Ms Ricci told Mr. Price is all they want to do is the business of the City.

Mr. Kraft called for the question.

Mr. Price asked for a Roll Call
Motion was to amend Resolution 2011 – 5 by removing the bullet point stating “Became
physically menacing to Councilmembers by rising from your chair and shaking your index
finger in their faces.”

Roll Call vote was:
AYES: Mr. Kraft, Mr. Glickert
NAYS: Mr. Price, Ms. Ricci, Mr. Crow, Mayor Welsch
The amendment failed

Mr. Price said because one is an attorney, it does not mean they are the best attorney. He
said his colleagues up here that access data bases, take data – social security numbers of
employee file off premise. Mr. Price asked Madam Chair to ask Councilmember Kraft to
respect.

Mr. Kraft call A Point of Order stating that you cannot attack motives and Mr. Price said he
was not attacking as this is fact. He said everybody at that meeting knows that he did not
leave his chair, walk over to Mr. Glickert and shake my finger in his face. Mr. Price said he
knows that and that is why he voted to remove it. Mr. Price said it is a total fabrication. Mr.
Price said one of his colleagues sent repeated information out that he knew to be
inaccurate. He asked if it was accurate when the Wilson People were told that the buyout
would start on the 19th, was he accurate when he said if we recycle we could reduce
dumping fees. He said he has never stated anything that is inaccurate, so there is no
substantiation from the Mayor that I am telling the community something inaccurate. On the
point of impugning the reputation of other members, he finds it ironic that when he comes
into the Council meeting it appears that everybody already knows the whole agenda. Mr.
Price said this opinion that supposedly Mr. Mulligan gave, he never received and asked Mr.
Sharpe if he had, which he said no. He said the City Attorney never approached him and
said Mr. Price if you do this it puts the City in jeopardy. He said Mr. Crow and Mr. Sharpe
were not told that. Mr. Price said he is sorry but he will shake his index finger. He said it is
total fabrication attacking him and his office. Mr. Price said if he tells someone that he
doesn’t trust them and they are not near him, he has to point at him. The next bullet point
was on questioning the City Manager repeatedly and not providing him with sufficient time
to respond. He said the City Manager is not elected. Mr. Price said the elected officials up
here have been charged by the citizens to look out on their behalf. He doesn’t even
represent the residents on Wilson and as he recalls their Council people voted against
giving them the buy-out money.

15
