RESOLUTION 2011 - 5 <br />RESOLUTION OF THE CITY COUNCIL's REPRIMAND OF COUNCILMEMBER PRICE IN <br />ACCORDANCE TO COUNCIL'S RULES AND REGULATIONS AND THE CITY <br />CHARTER <br />WHEREAS, the City Council of University City has adopted its Rules for Order and <br />Procedure and has determined that its proceedings will be guided by Robert's Rules as <br />Revised; and <br />WHEREAS, the Mayor serves as Presiding Officer of the City Council and is charged <br />with maintaining decorum on the Council; and <br />WHEREAS, Mayor Shelley Welsch has expressed her concern to Councilmember <br />Byron Price about his disorderly conduct in Council meetings, in letters sent to Mr. Price <br />on October 13, 2010 and February 17, 2011; and <br />WHEREAS, the City Charter of University City allows for the City Council to punish its <br />members for disorderly behavior; and <br />WHEREAS, members of this Council have concerns about Councilmember Price's <br />behavior at its meeting on February 14, 2011, including the following items set forth in <br />the Mayor's letter to Mr. Price of February 17, 2011 where the Mayor stated that Mr. <br />Price: <br />• Refused to accede to the Mayor's ruling that he was Out of Order; <br />• Defamed City Manager Lehman Walker; <br />• Spoke in a bullying fashion to the Director of Community Development Andrea <br />Riganti and other members of the Council; <br />• Refused to limit his comments to the timeframe specified in the Council rules, <br />even after being advised of the need to do so; <br />• Questioned the City Manager repeatedly while not providing him with sufficient <br />time to respond; <br />• Verbally attacked one Councilmember on three separate occasions; <br />• Verbally attacked the Mayor and her office; <br />• Became physically menacing to Councilmembers by rising from his chair and <br />shaking his index finger in their faces; <br />• Impugned the reputation of other members of Council by stating that they had <br />contravened the Sunshine Law; <br />• Repeated information that he knew to be inaccurate, thereby misinforming <br />residents of our community. <br />NOW THEREFORE BE IT RESOLVED, that this City Council formally reprimands <br />Councilmember Byron Price for his disorderly behavior at the City Council meeting held <br />
