Hill, Zoning Administrator <br /> <br />CASE #2322 - REAR YARD VARIANCE FOR REAR ADDITION, DONALD MILLS, <br />REPRESENTED BY STAN GOLDSTEIN OF S & G BUILDERS, 7752 BURR OAK <br /> <br />Donald Mills, Represented by Stan Goldstein of S & G Builders requested a rear yard variance <br />of Section 34-30.3(d) to construct an addition to the rear of his home that will encroach 4' into <br />the 30' required rear yard at 7752 Burr Oak. The variance was granted by a vote 5 - O. <br /> <br />CASE #2325 - SIDE YARD VARIANCE FOR DECK AND HEIGHT VARIANCE FOR <br />FENCE, R. L. AXELBAUM, 7918 GANNON <br /> <br />R. L. Axelbaum requested two variances of: 1) Sections 34-52.5(b) and 34-30.3(c) in order to <br />keep a deck that encroaches 5' into the required 6' side yard and 2) Section 34-24.4 to keep a <br />fence on top of that deck that exceeds the height limit of 6' above the natural grade at 7918 <br />Gannon. The variance for the deck was granted by a vote of 5 - O. The variance for the fence <br />was denied by a vote of 5 (nay) - 0 (aye). <br /> <br />CASE #2326 - APPEAL/REAR YARD VARIANCE FOR CARRIAGE HOUSE, <br />MERCANTILE BANK & TRUST CO., TRUSTEE FOR LUKE E. HART, <br />REPRESENTED BY ROY J. ZINGRICH, 6306 MCPHERSON <br /> <br />Mercantile Bank & Trust Co., Trustee for Luke E. Hart represented by Roy J. Zingrich <br />requested an appeal of the Zoning Administrator's ruling that the non-conforming carriage house <br />is destroyed to the extent of more than 50% of its replacement cost thereby preventing <br />restoration, and in the alternative requested a variance of Section 34-52.5 to repair fire damage <br />and restore the present carriage house that encroaches 5' into the required 5' rear yard setback <br />for accessory uses at 6306 McPherson. The appeal was not voted upon. The variance was <br />granted by a vote of 5 - O. <br />
