The granting of this Conditional Use Permit shall not be construed as approval or <br />authorization for the second phase of the development described in the <br />application supplements. <br /> <br />Mr. Kendall seconded the motion which passed by a vote of 6-0. <br /> <br />REQUEST FOR SUBDIVISION OF WESTOVER CENTER TRACT - REVIEW OF RECORD PLAT <br /> <br />Chairman McCauley informed Commission members that Mr. Gary Berutti of KBR <br />Engineering, Inc., and representing the Westover Center Partnership, requests Plan <br />Commission review and approval of a record plat for subdivision of the Westover <br />Center property in the 7900 block of Olive Boulevard. Mr. Berutti explained that the <br />property, the former site of the Westover Nursery, is approximately 6.1 acres and has <br />been approved by the City Council as the site of a retail center and a freestanding <br />grocery store. Lot 1 is to be the separately owned site for the grocery and Lot 2, <br />north of the 10' wide MSD easement, will be the site of the retail center. Much of <br />the land south of the MSD easement is floodplain and will not be developed at this <br />time. <br /> <br />Ms. Elwood indicated that the attached Subdivision Plat of Westover Center meets the <br />requirements of the University City Subdivision Ordinance, Section 29-3(b). Both <br />Lots 1 and 2 exceed the minimum lot area for the "GC" zoning district in which they <br />are located. The subdivision and subsequent separate ownership of Lots 1 and 2 <br />presents a situation typical of development along Olive Boulevard. Specifically, one <br />business will be located on a lot which does not contain the code-required parking <br />for that business and, therefore, must rely on an adjacent, separately owned lot to <br />provide its parking needs. At Westover Center, this dilemma will be rectified by the <br />provision on Lot 2 of a parking area easement and an ingress and egress easement for <br />the specific benefit of Lot 1 (the grocery store property). Ms. Elwood went on to <br />explain that the easements had been specifically located as had the new entrance/exit <br />on Mount Olive Avenue pursuant to a study by a qualified traffic engineer as required <br />by the City Council under the Westover Site Plan approval. Mr. Berutti and Dan <br />Steuber, representing the Westover Partnership, presented a site plan showing the <br />location of the entrance/exit on Mount Olive as it had been approved by the Director <br />of Public Works as well as a plan locating all proposed easements on the property. <br /> <br />Chairman McCauley asked if the parking and access easements were non-exclusive, <br />reciprocal easements. Mr. Berutti understood that they would be. Mr. Rice wanted to <br />make sure that the parking area easement would run with any sale of Lot 1. Mr. <br />Steuber replied that this would be the case. <br /> <br />After a brief discussion, Ms. Kreishman recommended that the Plan Commission approve <br />the Record Plat for the Westover Center Tract subject to the following conditions: <br /> <br />1. The approximate parking area easements and ingress/egress easements shall be <br />recorded on the Subdivision Plat of Westover Center prior to the secretary and <br />Chairman's signatures on the plat. <br /> <br />2. Location of the Mount Olive Avenue driveway shall be finalized in accordance with <br />the study by a qualified traffic engineer, and dedication of the additional <br />right-of-way to the City of University City necessary to relocate the driveway <br />shall be accomplished by the plat. <br />
