<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 2 <br />February 22, 1989 <br /> <br />Chairman McCauley called for Mr. Goldman's report and recommendation on the <br />application. Mr. Goldman reiterated that the Plan Commission was reviewing this <br />application because the "GC"-General Commercial district regulations required the <br />issuance of a conditional use permit before operation of a carry-out restaurant <br />was permitted, even in an existing building or portion thereof. He continued by <br />explaining that while the plan submitted with the application was not wholly <br />accurate, the most important issue with respect to the application is assurance <br />of adequate parking for the restaurant in relation to the other business tenants <br />in the Jeffrey Plaza. Mr. Goldman was reasonably assured of adequate parking, <br />even during peak hours, for the restaurant's use at the eastern end of the site. <br />Little detail had been provided in order for the staff and the Commission to <br />determine the exterior appearance of the store; however, Mr. Goldman saw no <br />reason to not recommend approval of the application. <br /> <br />Chairman McCauley called on the applicant and his associates to respond to <br />questions by Commission members. Mr. Marsh asked what plans the applicant had <br />for exterior signage. Mr. Hutkin replied that the applicant and he had agreed on <br />an illuminated, open-letter sign of a size and style that conformed with the <br />University City Sign Code as well as with the sign criteria Hutkin had developed <br />for the plaza. Mr. Hutkin also explained that he would discourage sign clutter <br />in the window of the storefront and had already conferred with the applicant on <br />this point. Hutkin Development was convinced that the appealing, lighted <br />interior of Little Caesars would project a positive image. Mr. Rice verified <br />that there were no plans for a drive-through window at the proposed location and <br />also asked about the potential need for a condition or assurance from the <br />applicant that the area be patrolled to prevent litter from the cups and boxes <br />from the business. Mr. Dailey replied that there should be only a small <br />potential for litter; less than 10 percent of the pizza is sold by the slice and <br />less than one percent of sales is from cups of soda. Mr. Goldman concurred that <br />the potential litter problem from this particular business would be small. Mr. <br />Wagner asked if there would be anyon-premise dining. Mr. Rybowicz indicated the <br />possibility of a small stand-up dining counter in the restaurant. Ms. Kreishman <br />asked about the projected hours of operation. Mr. Rybowicz stated that the hours <br />would be consistent with the Jeffrey Plaza's hours, probably 11:00 a.m. to 12:00 <br />a.m. on weekdays and 11:00 a.m. to 1:00 a.m. on weekends. <br /> <br />After this discussion, Mr. Safe moved that the application for Conditional Use <br />Permit #273 be approved. Mr. Kendall seconded the motion. Mr. Rice suggested <br />that the motion include the following condition: <br /> <br />1. The operator shall regularly police the site and the area adjacent to the <br />restaurant to remove any litter generated by the business. <br /> <br />As this condition was acceptable to those proposing the motion, after further <br />discussion, the motion, including the one condition, passed by a vote of 7-0. <br /> <br />REVIEW OF PLANS FOR DETACHED SINGLE FAMILY DWELLINGS IN ACCORDANCE WITH <br />CONDITIONAL USE PERMIT #266A. <br /> <br />Mr. Mark Conner, one of the developers of the Hanley Junior High School site, <br />informed members that the Planning Department staff had requested a Plan <br />
