<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 3 <br />September 27, 1989 <br /> <br />Chairman McCauley confirmed with the residents present that much of their concern <br />centered around traffic problems potentially created by the new shopping center in <br />general. The residents agreed and felt that a clean and neat auto repair facility as <br />a part of the center could be compatible with the surrounding areas. Mr. Goldman <br />responded to the neighbors' concerns for traffic hazards in the area by explaining <br />that as a part of the previous Site Plan Review and Subdivision approvals for Westover <br />Center, the eastern portion of the site had been engineered to locate the service <br />entrance off of Mount Olive such that the grades and site distances would reduce some <br />of the current traffic hazards. He further explained that to accomplish this the <br />Westover Partnership was required to deed a small portion of the site to the City to <br />improve the Groby Road/Mount Olive intersection. After further discussion regarding <br />the location of the service drive and the potential for a "stop" or "yield" sign at <br />the service exit, the Chairman closed the public hearing. <br /> <br />Mr. Kendall then moved that the Plan Commission recommend approval of the application <br />for Conditional Use Permit '277 subject to the following conditions: <br /> <br />1. No freestanding signs shall be permitted for the vehicle repair facility. <br /> <br />2. Overnight parking or storage of motor vehicles shall not be permitted. <br /> <br />3. Exterior colors and materials shall be reviewed and approved by the City Manager. <br /> <br />The motion was seconded by Ms. Kreishman with the suggestion that a fourth condition <br />be added, as follows: <br /> <br />4. This conditional use permit shall be valid for Firestone or a similar national <br />auto repair chain only. Any other auto repair or auto-related buyiness shall need <br />to apply for and obtain a separate Conditional Use Permit approved by the Plan <br />Commission and City Council. <br /> <br />Mr. Kendall agreed to accept the fourth condition as a part of his motion. Chairman <br />McCauley raised the question as to whether Firestone would automatically be bound to <br />the hours of operation stated in the application. Mr. Safe suggested a fifth <br />condition: <br /> <br />s. The hours of operation shall be limited to those detailed in the application for <br />this conditional use permit, dated August 31, 1989, and are as follows: <br /> <br />Monday - Friday: <br />Saturday: <br />Sunday: <br /> <br />7:00 a.m. - 8.00 p.m. <br />8:00 a.m. - 6:00 p.m. <br />11:00 a.m. - 4:00 p.m. <br /> <br />Mr. Kendall and Ms. Kreishman agreed to accept the fifth condition as a part of the <br />motion. The motion to recommend approval of the application with the five conditions <br />passed by a vote of 4-0. <br /> <br />Chairman McCauley informed those present that the application would be forwarded to <br />the City Council for its consideration on Monday, October 2, 1989. He directed Ms. <br />Elwood to inform the applicant of the Commission's recommendation and forthcoming City <br />Council meeting. <br />
