The vote taken on <br />the application was 6-0 in favor of a recommendation to deny. <br /> <br />PUBLIC HEARING - APPLICATION FOR AMENDMENT OF CONDITIONAL USE PERMIT #197 TO PERMIT <br />CONSTRUCTION OF A NEW DRIVE-IN TELLER AT 6630 DELMAR BOULEVARD <br /> <br />Chairman McCauley informed those present that the Plan Commission had scheduled a <br />public hearing on an application for amendment of Conditional Use Permit #197 by Mr. <br />Michael Feulner of Tower Properties, representing the Commerce Bank at 6630 Delmar <br />Boulevard. The application was a request for permission to construct a new drive-in <br />automatic teller facility (ATM) at the Delmar location. The Chairman reiterated the <br />Commission's procedure. <br /> <br />Chairman McCauley called on the applicant to present information on the application. <br />Mr. Feulner explained that it was Commerce Bank's intent to replace the accessory <br />building which houses the existing ATM with a new machine protected by a freestanding <br />canopy over a concrete island as depicted by the drawing submitted with the <br />application. He stated that the overall dimensions of the proposed canopy would be <br />approximately the same as those of the existing building. This ATM replacement <br />proposal was part of a county-wide program to replace deteriorating ATM's at certain <br />locations with canopies designed to provide a safe, open environment. Mr. Feulner <br />responded to the Planning Director's report he received prior to the meeting by <br />stating that the signage and graphics proposed for the canopy are needed on at least <br />three (3) sides to alert customers to its location. Even this amount of signage <br />represented a decrease over the amount of signage on the existing ATM building. Mr. <br />Feulner distributed photographs and a dimensioned drawing of the type of canopy and <br />machine proposed. <br /> <br />Chairman McCauley asked Mr. Goldman to present his report on the application. Mr. <br />Goldman stated that the dimensions regarding the height of the canopy and the <br />approximate area of the canopy signs had been clarified by the distributed materials. <br />However, in his judgment, the signing on the faces of the canopy converts the entire <br />canopy into a sign. He believed that there is no need for this amount of signage, and <br />it should not be permitted. He suggested that the signage be limited to the east face <br />of the horizontal member depicted between the posts just under the canopy. He felt <br />that such a sign should be sufficient to identify the ATM without making the entire <br />structure a sign. Mr. Goldman recommended that the application be approved with the <br />sign he proposed as well as with canopy illumination limited to the underside of the <br />canopy. <br /> <br />The Chairman asked if Commission members had any questions for Mr. Feulner. Mr. Safe <br />stated that the major issue regarding the placement of the ATM at this location was <br />the curb cut on Delmar Boulevard which was supposed to permit only the traffic exiting <br />onto Delmar from the bank parking lot and the ATM. Mr. Safe explained that the curb <br />cut was ineffective at prohibiting incoming traffic and provided a confusing and <br />potentially dangerous pedestrian situation on Delmar. He suggested that a condition <br />of the permit be that this curb cut be closed and the ATM relocated on the property if <br />necessary. Loop South should be used as the appropriate service access to this <br />property. Mr. Goldman explained that this was the original recommendation for the <br />permit application for the current ATM as well the recommendation of the original <br />Delmar Loop Urban Renewal Plan.
