<br />. <br /> <br />. <br /> <br />PLAN COMMISSION <br /> <br />Minutes <br /> <br />January 24, 1990 <br /> <br />T~e City Plan Commission held its regular meeting in the Emergency Operations Center of <br />City Hall on Wednesday, January 24, 1990, convening at 7:30 p.m. with Chairman Matthew P. <br />McCauley presiding. <br /> <br />VOTING MEMBERS PRESENT <br /> <br />Matthew P. Kendall <br />Stephen Marsh <br /> <br />Councilmembers Present: Robert Wagner, Council Liaison; Byron Price, 3rd Ward <br />Councilmember. <br /> <br />Staff Present: Frank Ollendorff, City Manager; Al Goldman, Director of Planning; Sarah <br />Elwood, Zoning Administrator. <br /> <br />APPROVAL OF MINUTES <br /> <br />Mr. Marsh moved that the minutes of the December 5, 1989, meeting be approved as <br />submitted. Mr. Foxworth seconded the motion which passed by a vote of 4-0. <br /> <br />PUBLIC HEARING - APPLICATION FOR CONDITIONAL USE PERMIT #279 TO ALLOW A DRIVE-THROUGH <br />RESTAURANT AT 6221 VERNON AVENUE AT SKINKER BOULEVARD <br /> <br />Chairman McCauley informed those present that the Plan Commission had scheduled a public <br />hearing on an application for a Conditional Use Permit by Shoney's, Inc. This company is <br />requesting that a portion of the property at 6221 Vernon Avenue at Skinker Boulevard be <br />approved for a Lee's Famous Recipe Chicken drive-through restaurant in accordance with <br />Zoning Code Section 34-38.4(2). The Chairman then outlined the Commission's procedures <br />and criteria for reviewing the application. <br /> <br />Mr. Ed Cody, attorney for Shoney's, Inc., was present to represent the company. Mr. Cody <br />explained that Shoney's proposes to construct a Lee's Famous Recipe Chicken drive-through <br />and eat-in restaurant on a portion of the property at the northwest corner of Skinker <br />Boulevard and Vernon Avenue. The entire parcel had previously been the subject of a <br />development proposal which included a muffler shop and a convenience store/gasoline <br />station; however, this combination was no longer being proposed due to the bankruptcy of <br />the previous developer. Now, Mr. Cody explained, Shoney's proposes a family restaurant <br />for the southern portion of the site with a separate developer anticipating retail <br />development for the balance of the site. Mr. Cody introduced the St. Louis division <br />director for Shoney's, Mr. Gamache, who detailed the marketing direction for Lee's <br />restaurants. He depicted the proposed restaurant as a family restaurant which would not <br />serve liquor. Mr. Gamache showed Commission members a picture of an existing restaurant <br />as an example of how the proposed development would look. Mr. Cody then responded to the <br />Planning Director's recommendation on the application dated January 17, 1990. Mr. Cody <br />stated that Shoney's would prefer to erect a vinyl-coated, chain-link fence to a height of <br />eight (8) feet along the west property line instead of a masonry wall. Citing several <br />economic factors, Mr. Cody stated that Shoney's would prefer to spend additional money on <br />
