Ms. Annie Carey of 7536 Melrose Avenue expressed concern about extending the <br />restaurant's hours to 1:00 a.m. on weekends. She wondered about the precedent that could <br />be set for restaurants in other locations in the city. Chairman McCauley replied that <br />when the Plan Commission and City Council consider applications for restaurants or other <br />businesses requiring a Conditional Use Permit, each is judged individually based on its <br />location, proximity to residential neighborhoods and other potential nuisance factors. As <br />there were no other questions or comments from those present, Chairman McCauley closed the <br />public hearing. <br /> <br />Mr. Marsh asked those representing Shoney's what assurance the neighbors would have that <br />the drive-through speaker would be kept at an appropriate volume. Mr. Gamache replied <br />that the speaker's volume is adjustable and Lee's has been responsive in other cities to <br />requests to lower the volume. Mr. Kendall specifically discussed the proposed hours of <br />operation with Shoney's representatives who reiterrated their need to keep the <br />drive-through service open until 1:00 a.m. on weekends. Mr. Kendall also asked if it was <br />Shoney's experience that their customers obeyed the compact car designations on certain <br />parking spaces. Mr. Lockhart replied that this was usually not a problem. Chairman <br />McCauley asked Mr. Goldman if a condition regarding litter control would be appropriate. <br />Mr. Goldman replied that it is appropriate but was very difficult to police. In response <br />to a question by Mr. Geiger, Mr. Goldman stated that the approval of the City of St. Louis <br />Traffic Division would be required for curb cuts off of Skinker, and the approval of the <br />St. Louis County Department of Highways and Traffic would be required for driveway <br />entrances off Vernon. Chairman McCauley also suggested that any sidewalk along the <br />property lines be brought into good repair. Mr. Foxworth confirmed Shoney's willingness <br />to provide an adequately dense landscape buffer in conjunction with a vinyl-coated <br />chain-link fence along the west property line. <br /> <br />After further discussion regarding appropriate hours of operation and the Lee's restaurant <br />being an asset to an underutilized and deteriorating site, Mr. Marsh moved that the Plan <br />Commission recommend approval of Shoney's application for a Conditional Use Permit subject <br />to the following conditions: <br /> <br />1. Landscaping shall be installed and maintained in accordance with a detailed <br />landscaping plan reviewed and approved by the Director of Planning. <br /> <br />2. A vinyl-coated chain-link fence, maximum eight (8) feet in height, and appropriate <br />landscaping shall be installed along the west and north property lines except in <br />those areas used for driveways. <br /> <br />3. The hours of operation shall be limited to 8:30 a.m. to 11 p.m. Sunday through <br />Thursday and from 10:30 a.m. to 12 midnight on Friday and Saturday. <br /> <br />4. The drive-up window loudspeaker shall be located close to the driver's position <br />and the volume shall be maintained low enough to avoid disturbing residents of <br />nearby apartment buildings. <br /> <br />5. The approval of the City of St. Louis Traffic Division and the St. Louis County <br />Department of Highways and Traffic shall be obtained for the driveway entrances <br />prior to the issuance of a building permit. <br /> <br />6. The angled undersized parking spaces depicted on the site plan submitted with the <br />application and dated 1/12/90 shall each be labeled "For Compact Cars Only." <br />
