<br />Plan Commission Me~rs <br />October 24, 1990 <br />Page 4 <br /> <br />. <br /> <br />Ms. Ratner stated her belief that the new state law did require <br />amendment of the current University City Zoning Code. She had <br />several questions concerning the proposed definitions, <br />specifically, any potential difference between Nursing Homes and <br />Convalescent Homes. Chairperson Kreishman also questioned these <br />proposed definitions as well as the proposed definition of a <br />hospital. Commission members discussed the definitions included in <br />Chapter 196 of the Missouri Revised Statutes for the various levels <br />of residential nursing care. with regard to the current Zoning <br />Code's provision for "Convalescent Homes", "Nursing Homes", and <br />"Hospitals" in its various zoning districts, Commission members <br />agreed that the Code should mirror the state's codified definitions <br />as closely as possible. Commission members also discussed the <br />differences and similarities of medical offices versus medical <br />clinics. Commission members agreed that the current University <br />City Zoning Code should be amended to include specific definitions <br />for its medically-related uses. <br /> <br />Commission members also reached a consensus that the new State <br />Statute required the City to amend its Zoning Code to include <br />provision for both residential and outpatient facilities for the <br />treatment of alcohol or other drug abuse. Ms. Ratner expressed her <br />strong belief that provision for such facilities should be made in <br />districts other than just the "IC"-Industrial Commercial District. <br />Chairperson Kreishman reviewed with the members the various zoning <br />district provisions and which should be amended to include the <br />newly required uses. After this discussion, Ms. Ratner moved that <br />the Plan commission recommend adoption of the following text <br />amendments, thereby amending Section 34-35.4 of the University City <br />Zoning Code by adding a new subsection (12) and also amending <br />section 34-40.3(b): <br /> <br />Section 34-35.4 <br />(12) Residential and Outpatient Substance Abuse Treatment <br />Centers <br /> <br />Section 34-40.3(b) <br />Hospi tals, Residential and Outpatient Substance Abuse <br />Treatment Centers, and other institutions of a religious, <br />educational, charitable or philanthropic nature, provided <br />that such buildings shall not be located upon sites <br />containing less than three (3) acres. <br /> <br />Ms. Ratner indicated that, if passed, this recommendation could be <br />forwarded to the City Council and potentially passed into law <br />before the January, 1991, deadline. In the meantime, Planning <br />staff and the Plan Commission could work to define all medically- <br />related uses mentioned in the Zoning Code, and could recommend by <br />late November or early December that such definitions be included <br />in the Code in due course. Mr. Goldman mentioned that perhaps <br />Planning staff and the Plan Commission could provide the proposed <br />definitions to the City Council prior to its passage of the just <br />
