Mr. Marsh and Mr. Foxworth emphasized that it is the applicant's <br />responsibility to police the parking lot for illegal parking. Mr. Marsh asked Mr. Goldman when <br />the applicant was told that he must apply for a new Conditional Use Permit. Mr. Goldman <br />stated that he was informed in June. However, there were some delays in the application <br />process on the part of the applicant. Mr. Marsh stated that he had concerns that the auto repair <br />use broke up the retail quality of the Loop district. Mr. Feldman responded that if a restaurant <br />or retail use to took over the location, they would have to spend great amounts of money to <br />rehab the place for their use. Mr. Feldman emphasized that the current use is very clean and <br />quiet. Mr. Goldman stated that the City has not had any complaints about the location since Mr. <br />Feygelman took over. <br /> <br />The Chairperson asked for comments from the public. No comments from the public were <br />made. The public hearing was closed. <br /> <br />Mr. Safe clarified that the whole reason this use was before the Commission was because the <br />location no longer sells gas and now only repairs autos. Ms. Ratner stated that she felt that the <br />only reason the use is still there is because it has not come up for review since 1965. Mr. <br />Goldman stated that the filling station was the first project to be redone under the urban renewal <br />program. Mr. Feldman stated that it is convenient to have an auto repair facility in a retail <br />district. He also stated that none of the other retailers in the area complained about the use after <br />notification except the owner of the Apt. Building at 6301 Delmar who was not even concerned <br />enough to come to the meeting. Mr. Safe stated that he felt that the operation as it is being run <br />now permits no basis for the Commission to oppose. Ms. Kreishman stated that under the <br />current economic conditions it is better to have this use at that location then to have a vacant <br />building. <br /> <br />Ms. Kreishman stated that the conditions in the Staff Review should be amended to include: <br />signs should strictly comply with the University City Sign Code; the landscaping shall be <br />finished by May 1, 1992; that the trash receptacles should be moved to the rear of the building <br />after the paving is finished but no later than May 1, 1992; and that a new condition stating that <br />the existing fuel pump island should be removed prior to May 1, 1992. <br /> <br />Mr. Marsh stated that he will vote against the use because he feels it is not consistent with the <br />retail district and is not a proper Loop entryway. Mr. Kendall expressed concern that the <br />applicant would comply with the May 1, 1992 deadlines since he dragged his feet in applying <br />for the Conditional Use Permit. Mr. Feldman re-emphasized that Mr. Feygelman will meet all <br />of the conditions by the deadlines. Ms. Ratner stated that she felt the use was not consistent <br />with the comprehensive plan's projections for the Loop district. <br /> <br />Mr. Foxworth moved that the Plan Commission recommend approval of the Conditional Use <br />Permit subject to the following conditions amended from the Staff Recommendation: <br /> <br />m-1-22.plc <br />
