<br />. . . <br /> <br />. <br /> <br />. <br /> <br />January 22,1992 Plan Commission Meeting Minutes Page 9 <br /> <br />proposed west lot, stated that the resubdivision will change the neighborhood, property values, <br />affect his view from his back yard, will diminish the enjoyment of his own property and that the <br />true frontage of the lot will be 95' not 100'; Meredith Payne - 7314 Westmoreland states that <br />the historical attributes of the neighborhood will be affected; Jerry Spector - 7365 Westmoreland <br />stated that he opposes the resubdivision because it breaks up the character of the block and will <br />only benefit the owner of the lot while the rest of the neighborhood will suffer; John Boyce - <br />7341 Maryland states that the neighbors have more at stake in the property than the owners of <br />the lot and the resubdivision breaks the responsibility that one neighbor has toward another in <br />the use and development of their property; July Bloomquist - 7103 Westmoreland stated that the <br />resubdivision will reduce the beauty of upper Westmoreland; Leo Brown - 7329 Maryland stated <br />that the neighborhood's unique qualities have attracted many home-owners to it; and Don Bellum <br />- 7324 Westmoreland stated that if the resubdivision is approved, there should be conditions put <br />on the approval. <br /> <br />Linda Comfort, owner of7346 Westmoreland spoke out in favor of her own proposal, stated that <br />they had sent out letters to the neighbors but there was no response. She emphasized that they <br />will not build a house that is incompatible with the neighborhood. The reason the lot is shaped <br />the way it is, is to protect the historical quality of the lot as it currently exists. Thirty-seven <br />people attended this hearing. The public hearing was closed. <br /> <br />Mr. Kendall asked whether the Commission could make a decision to turn down the application <br />without prejudice. Mr. Goldman stated they could. Ms. Ratner stated that the Comprehensive <br />Plan of 1986 calls for substantial conformance with surrounding structures. She also stated that <br />the Plan calls for protecting the individual character of residential neighborhoods. She feels that <br />the presented plan for a "step" home would not preserve the character of the homes in the <br />neighborhood, since they all have "flat" frontages. Mr. Safe stated that his only objection to <br />the proposal is the "gerrymandered" shape of the lot. <br /> <br />Mr. Kendall moved that the Plan Commission recommend denial of the resubdivision with the <br />condition that applicant be allowed to resubmit a new plan without having to pay a new fee <br />(without prejudice). Mr. Safe stated that he will vote against the resubdivision solely because <br />of the irregular shape of the lot. Ms. Ratner stated that she will vote against the resubdivision <br />because it violates the Comprehensive Plan. The motion was seconded by Ms. Ratner and <br />passed by a vote of 6 - O. <br /> <br />DISCUSSION OF PROPOSED "FINDINGS OF FACT" VOTING BALLOTS <br /> <br />Mr. Hill presented a draft of a voting ballot for possible use by members while voting. It was <br />decided that the letters to City Council will be more specific concerning the votes of the <br />members. The proposed ballots should be distributed along with the packets. Use of the ballots <br />will be optional on the part of the Commission Members until a final decision on their use is <br />made. <br /> <br />m-1-22.plc <br />
