<br />. <br /> <br />. <br /> <br />February 26, 1992 Plan Commission Meeting Minutes Page 3 <br /> <br />Mr. Kendall asked Mr. Bell whether he had purchased the exhaust system yet. Mr. Bell stated <br />that it was already set up. <br /> <br />Mr. Marsh stated that it was difficult for him to make concessions at this time until all of the <br />conditions of the original permit were taken care of. He suggested that the hearing be postponed <br />until landscaping had been installed. <br /> <br />The Chairperson asked for comments from the public. Monica Stewart, 1066 Pennsylvania, <br />stated that she did a survey of the residents of the streets nearby to the operation and that most <br />people were against the amendment. She presented a petition against the amendment, signed by <br />many residents. Mr. Safe asked whether the petition represented the people of the <br />neighborhood. Ms. Stewart replied that it did. She further stated that people felt the operation <br />was noisy, the new hours were not good for the school-aged children in the neighborhood, it <br />looks bad, smells bad, trash is allover the lot, traffic has increased, no other restaurants stay <br />open that late in the area and the landscaping has not been installed. She further stated that a <br />mattress had remained in the parking lot for several weeks. <br /> <br />Mr. Bell responded by stating that the reason there was trash on the lot, was because people <br />from the neighborhood were using it as a public dumpster. He has since put a lock on the <br />dumpster and the problem has ceased. The mattress mentioned by Ms. Stewart was actually <br />dumped on the lot by an outsider and had frozen to the ground, and therefore he was unable to <br />remove it until the weather warmed up. He further stated that he wanted to be a positive part <br />of the neighborhood and feels that he will have a thriving business in the future. Ms. Kreishman <br />pointed out that the property looks worse now than it did before Mr. Bell took over the business. <br />Mr. Bell stated that he really needs the extended hours to pay for the improvements. He also <br />stated that he will have 2 - 5 employees there at a time, so Mr. Goldman's concern about the <br />operation being unsafe at late night hours was unfounded. He stated that the police and his <br />insurance company do not see the hours of operation as a risk. Mrs. Bell stated that their <br />operation did not increase the already busy traffic on Olive. Mr. Bell stated that the <br />restaurant's smell does not leave the property. The public hearing was closed. <br /> <br />Mr. Marsh moved that the Plan Commission make no action on the application until the next <br />meeting when the landscaping had been installed. He further stated that holding the application <br />over until the next meeting does not necessarily mean it will be approved. <br /> <br />The motion was seconded by Ms. Ratner and passed by a vote of 6 - O. <br /> <br />PUBLIC HEARING FOR CONDITIONAL USE #303 - SYNAGOGUE. 8041 - 8101 DELMAR <br /> <br />Chairperson Kreishman informed those present that the Plan Commission had scheduled the <br />public hearing on an application from Young Israel of St. Louis, Inc. represented by Mr. <br />Stewart Zimbalist, 8124 Amherst for a Conditional Use Permit to allow a synagogue at 8041 - <br />8101 Delmar. The Chairperson outlined the Commission's procedures and criteria for reviewing <br /> <br />m-2-26.plc <br />
