She explained that the resubdivision will divide the single 45,990 <br />square foot lot, 210 feet at the building line, into two lots. The proposed east lot will be 28,059 <br />square feet with a lot frontage of 110 feet at the building line; the proposed west lot will be <br />17,931 square feet with a lot frontage of 100 feet at the building line. Mr. Comfort will live <br />in the existing structure on the east lot and will construct a home for future resale on the west <br />lot. The property is located in the "SR" - Single Family Residential district. Section 34-30 of <br />the University City Zoning Code requires that lots in the "SR" district shall have a minimum <br />lot area 7200 square feet and a minimum lot width of 60' at the building line. Ms. Whittington <br />pointed out that Lot W will be larger than the lot located at 7308 Westmoreland and <br />approximately the same size as the lots at 7291 and 7300 Westmoreland. Lot W retains the 100' <br />frontage at the building line which far exceeds the 6O'10t width required by the Zoning Code. <br />Further, all requirements under Chapter 29 of the Municipal Code have been met. Ms. <br />Whittington stated that a proposed home would not violate the 30' rear yard requirement. The <br />prevailing height and mass standards can be adequately addressed. However, all of those <br />concerns are not the proper standard of review in a resubdivision application; they should be <br />addressed when a building permit is reviewed. The only issue before the Plan Commission is <br />whether or not the proposal meets the requirements set forth in the Zoning Code for a <br />resubdivision. Ms. Whittington stated that all requirements have been met. <br /> <br />Chairperson Kreishman asked Mr. Goldman to report on the staff review. Mr. Goldman stated <br />that Randall L. Comfort, owner of the property located at 7346 Westmoreland, has filed a third <br />application for a resubdivision of the parcel comprised of the east 50' of lot 11, all of lots 12 <br />and 13 and the west 40' of lot 14 in block 9 of Maryland Terrace amended subdivision No.2. <br />The proposal will divide the 45,990 square foot parcel into two irregular shaped parcels. Lot E <br />is shown 110 feet wide at the building line and will contain the existing house, garage and <br />swimming pool. Lot W will be 100 feet wide at the building line, maintaining this width for <br />the front 109.26 feet with an off-set that reduces the width to 50 feet at the rear property line. <br />The irregular shapes are due to the existing location of the pool and changing houses on the east <br />lot. Mr. Comfort occupies the house located on the proposed east lot; he plans to construct a <br />home on the west lot for future re-sale. <br /> <br />Section 34-24.2 requires that the lots conform with all the bulk regulations of the "SR" - Single <br />Family Residential District in which they are located. <br /> <br />The proposed lots will exceed the lot area and width standards of Section 34-30.3, which <br />requires each lot to have a minimum area of 7200 square feet and a minimum width of not less <br />than 60 feet at the building line. The east parcel will have an area of 28,059 square feet and <br />a width of 110 feet at the building line; the west parcel will have an area of 17,931 square feet <br />and a width of 100 feet at the building line. The lot widths conform to the prevailing pattern <br />of the parcels under single ownership which includes several 100 foot wide lots. The area of <br />Lot W is smaller than any of the existing parcels under single ownership and the angular <br />boundary will make it difficult to provide a 30 foot rear yard for a large building on the site. <br /> <br />m-4-22.plc <br />
